funny thing CITI, i backed out of the claim and after they paid 50% i said i would drop it if they also returned the court fee. funny thing was just before the court date they sent me a cheque for the balance. odd. that was back before the OFT thing though,0

So, did you go through the Court application via miney claim or just threaten itm the stage I'm lingering at..
Also are was both your claims for the credit cards and not Current accounts?

I have just recieved the email below from Brian Smith, Solicitor at Citi.
It was in response to my email to him his morning regarding me waiting si long for a response and threatening to go to court via money claim. All help on my next steps greatfully recieved....
Dear Mr Chambers,
Thank you for your email regarding your account.
With the greatest of respect, my client does not "fob" people off. It takes a view as to whether its charges are unlawful (they are not) and defends actions where it is appropriate to do so as I am sure you are aware. Having reviewed your account, I cannot advise my client to refund your charges as it is apparent that your account charged off owing some £2219.25.Given the fact that you owed my client such a large sum, it must be apparent to you that no amount is owed to you. Furthermore, the account was sold to Hillesden whom you may or may not yet have paid. In the circumstances, if you issue proceedings these will be defended as my client is of the view you have failed to pay the sum you are claiming and cannot therefore recover it as a debt or for any other reason. It is also of the view that these claims are misguided as they all have the assumption that you are owed money, an assumption my client has disproven in court on dozens of occasions. Furthermore, as my client has done nothing wrong I fail to see upon what basis the FOS could take issue. However, you must and, no doubt, will do as you see fit.

Please read and consider the following extract from the OFT’s statement
‘Where credit card default charges are set at more than £12, the OFT will presume that they are unfair, and is likely to challenge the charge unless there are limited, exceptional business factors in play. A default charge is not fair simply because it is below £12
A default charge should only be used to recover certain limited administrative costs. These may include postage and stationery costs and staff costs and also a proportionate share of the costs of maintaining premises and IT systems necessary to deal with defaults
as you see the oft does not say that £12 is the norm or base line for citi charges0 -

I'm just about to take citi on starting with statements and then the main fight( as i see with other peoples cases)
And i thought the halifax was trouble...
but in this case if i was fishing then halifax is a goldfish and citi is a PIKE:rotfl:

First letter and LBA sent to them March 07
Replies from them stating they were looking into things.
Heard nothing since May then cheque today for full amount claimed, i.e. £225 (not counting interest).

Hi all , just started down the citi card route myself, sent the letter and they cashed my cheque on the 6th september so just waiting to hear back from them now, keep you posted.

we got our statments this moring had to sign for them, is this normal from citi ?
At first glance it looks like £1000 in charges , between Sept 01 & August 04.
Whats the best next step with Citi , as from reading this thread they seem rather stubborn.

OH has been reclaiming charges back from citibank credit card, had a letter today from their solicitors agreeing to pay £84 which is the difference between £12 and £25 charged.OH is happy to accept this but they say the money has been credited to his account, the credit card has been paid off and the card cut up but he never closed the account.Does this mean he will be £84 in credit on his credit card and if it does how can he get the money he doesnt want to have a citi card.0
