I reclaimed the charges and the interest and was paid in full.
I claimed for my charges totalling £1000 and for the interest that I had then been charged on top of that which amounted to another £1000. My argument was that my overdraft was £1600 and had I not been fraudulently deprived of my money then Barclays would not of been able to charge me the amounts of monthly interest they had been.
I also added on the statutory interest for both amounts, but listed them seperately with my explanation for why I was doing this. Just in case they wouldn't pay the interest and so as not ruin the rest of my claim.
I did this as when reading the site it said it was like entering into a negotiation, so I was going to start as high as possible.
Barclays submitted a defence but paid out the full amount days before the court date to save us both the time and money!!(even though they still said they didn't agree with my legal point of view)0 -
Chrismce, the term is unlawfully, the bank does not commit FRAUD by charging you but they act UNLAWFULLY because they charge more than the true cost of penalty charges. Congratulations on the win
Kudox I have not said that you cannot claim them back, but merely that I think that you can ask the bank to explain the charges and they should be able to do so, which means YOU can CLAIM charges back.0 -

Contractual interest
This is what you see on your bank statements charged by the bank when you go overdrawn. It appears on your statement as 'INTEREST', or 'INT'.
There are normally two different interest rates charged. A lower rate is charged when you are overdrawn, but still within your agreed overdraft limit. Under no circumstances can this interest be reclaimed. There is a higher rate of interest (up to 29.9%) charged when you go over your overdraft limit (unauthorised overdraft). This is a bit trickier to deal with. You cannot claim any of this interest if your spending has caused you to go over your overdraft limit, but you can claim this interest on any bank charges that have caused this. The problem with this is working out the interest only on the charges. It can be difficult to get right, and you have to be very accurate with your figures in case the bank at any stage challenges them. Generally, most people don't claim this interest.
I know you must get fed up of being asked the same question re charges but I have searched through the threads for this:
M & S store card " letter fee" This is apertaining to late payment but the statement lists this as the only charge . I have £200. Would this be classed as a legit admin charge or could I try claimimg ?0 -

My building society just charged me £27.50 x 3 for my direct debit for my mortgage payment being returned due to insufficient funds. The thing is they have applied this "fee" to my mortgage. Is this lawful? Can they do this without asking me? And can I claim it back.? Thanks for any help.0

I apologise in advance that im am not very good at this thing.
Whilst being eldelry has taught me a lot of life skills, finnances is not one of them so i apologise if I am covering old ground here.
It would be very helpful to me if a list of the abreviations of the charges that can be reclaimmed specificaly from aNatwest can be listed here.
I have my bulk of statements been delivered to me but there is no key to what the abreviations mean and so i dont know which i can reclaim.

Hello I want to know if you can reclaim administration charges when they have been added because of a missed payment or late payment0

I have just rung First Direct to ask for the last 6 years of statements.
I was put on hold for a little while then she came back and said they could do that but she was just checking to see if the new system was in place.
The new system is that they will be able to send out just the charges on the account, you won't have to trawl through all the statements anymore.
Apparently this will be inplace on the 26th July and it will be quicker for them and us then the statement route. I have no reason to doubt this and am not assuming this is a delaying tactic.
So I will ring again on the 26th and ask for all the charges on both my accounts.
Maybe they will make this part easier but start taking all the cases to court, we'll see.
Maybe it was just getting a bit stupid and costly sending out all the statements by courier. Not very green that's for sure.
Anyway, not long to wait.0 -
Hi, I am with the HSBC. The only charges i have are:
interest on both bank account and credit cards
stopped cheque charge £10
credit card late payment fee £20
cash advance handling charge on a credit card £1.50 up to £3.00
Can anyone let me know which of these can be claimed please.
