Hello, I have got stuck already?? please help...I have my 6 years of statements, so I need to work out how much I can claim for, lets say I own them according to their monthly statments £1000, I have already paid them (including interest) about £900, on a credit card of £200..so...does that mean I can claim about £700, less the interest. If I win and get back the £700,(less the interest) what happens to the different between the £700 and the £1000 they said I own, as I haven't paid the different, have I.? so will it just be written of, the differents?.....sorry, but I don't seem to be able to find any threads about it.....but really just want to make sure I do it right........a very confused......Lilly
Im a bit confused by your post but here goes
Ignore what you owe or anything like that, just go through your statements, use Martins calculator & work out every charge they have applied to your account, it is your choice if you wish to go for interest also. Then send the letter, they have 14 days to reply & thats not 14 working days. If you get a reply with an offer its your choice if you take it, chances are though it will be ignored, read up on the Bank Reclaim section for timescales etc butbe prepared to do the court route, loads of people on here are in the same boat & Im more than happy to help you out as plenty others are, if your mega stuck click my name & send me a message.

Say for example your charges amount to £1000 but you have an overdraft or are in the red should we say by £700 then when your claim is successful the likely outcome is they would clear the £700 & then credit you either into your account or by cheque the other £300. Make sure your focus is on what they have charged you rather than anything else at first.

thank you Gareth, for your reply, I alway thought you only used the calulator on Martin's help page, if you were claiming interest as well, I think that is where I was getting confused!!!, I will look again in the morning, and hopeful it will make sense.......if not I will be back....Lol.......good luck every one.....Lilly0

My bank used to charge your quartely fees if you went overdrawn, this was fees for using your switch, cheques, dd's etc. They now charge a referrel fee. Can you reclaim the quarterly charges??

Were you being charged on a per item basis, of over £2.50?
Were the charges for not having funds for direct debits and standing orders or for going overdrawn?
Were they charged to your account in the past 6 years, even if you've closed the account now?

Hello Lozbingley, I was just get a bit confused, because, Captial one are saying I still own them about £1100. I have already paid about £900, but still own them this £1100, I had a credit limit of £200 to start with, I had a look at Martins Calculator, and worked it out that it was about £1100 (this needs to be double checked by me ),that was due in late payments and over Limit charges, (£20 each)so I am guessing ! I claim for the £1100, I am just getting confused as I haven't as yet pay £1100 only £900. if I am on the right track, I should get £600/£700 back (taking the interest off, that they have charge me) and the £1100 wipe of??? does that sound right?..... still a bit confused......Lilly....

Before I send on my, hopefully, final letter to the bank threatening to take them to court, I just want to check that what I am claiming for is legitimate. Can I claim for a S/O-D/D recall charge; an unpaid item charge; charge card misuse; unpaid item charge; unpaid bill payment and notified fees/charges?0
