    Either email or letter do not need to have been replied to.

    Sadly it is your choice to refuse delivery. As such the co have attempted to deliver the goods, so you have to chase the company for refunds.
    So on that point the bank is right and it is not illegal.


    So if you have not sent a email or letter, Do it now and then tell your bank that it has been cancelled. Effective the date sent.

    Clearly you have spoken to your bank. As such under PSD. They will take that date as your stop date and any further debits can be reclaimed and you refunded STRAIGHT AWAY.
    So have you been debited since you 1st spoke to your bank?

  • dear steve,i too ordered the free trial of the dead sea beauty kit and paid £3.99 postage,thinking it was safe to do so as the offer came on my lloyds tsb banking page.today they have taken £59.99 from my account,i immediatlly rang lloyds tsb who tell me they can do nothingabout this except stop any further payments to dead sea beauty and advise me to contact the company.do you have an address or number for them?

    OK, meeee toooo!

    This scam also appears on the legalbeagles web site and someone there suggested Section 78 of the Consumer Credit Act applied? Have read the section but it makes no sense to me. Can anyone else put it into plain English?

    I have also gone to their web site and used their customer support form to email them to cancel the autofill asap. Have also used their email address to copy that email so that I have some evidence that I have requested that stop. Thanks for the advice wrt Payment Service Directive as I to have to speak to the 'Fraud' section of my credit card company tomorrow. In the mean time they have put a temporary stop on the payments to this card. Thanks MBNA.

    I'm not sure why certain people on this thread are saying this ISN'T a scam ... leaving the financial issue aside: in fact DS Marketing are breaking the law on several counts:

    Firstly they fail to label their oproducts correctly:
    I contacted the CTPA (The Cosmetic, Toiletry and Perfumery Association)about the issue of product labelling on cosmetic items. Their response is as follows:

    Cosmetics

    Containers and/or packaging must state, in indelible, easily legible and visible characters:

    The name or trade name and address or registered office of the manufacturer or ofthe person responsiblefor marketing the cosmetic product within the Community;

    The nominal contents at the time of packaging, by weight or by volume;

    For products with a minimum durability of less than 30 months: the date of minimumdurability indicatedby ‘Best used before the end of ...’;

    For products with a minimum durability of more than 30 months: the period of timeafter openingfor which the product can be used without any harm to the consumer (this informationis indicated by a special symbol representing an open cream jar);

    Particular precautions for use;

    The batch number or product reference to permit identification;

    The product function.


    The labelling must also state a list of ingredients, in descending order, precededby the word ‘Ingredients’.



    The original framework Directive is 76/768/EEC, which sets out these specifications.

    Trading Standards are currently investigationg this firm as a result of their failure to comply with this legislation.

    Secondly, DS Marketing Ltd are implying that their products are 'cruelty free' by using the registered logos of Peta (People for the ethical treatment of animals) and BUAV (British Union for the Abolition of Vivisection) without authorisation. Both organisations are challenging them over this deceit.

    Thirdly, the ASA (Advertising Standards Authority) have received screen-shots of their online advert/website. Clearly the advertisement has been designed to mislead the general public. (Inferrance that the product has the approval of dermatologists etc; as well as the excessive use of 'photo retouching' in the 'before and after' images of alleged customers).

    Personally, after falling prey to these scam artists, I was refunded in full (£59.95) by my credit card provider ... and then, bizarrely, DS Marketing refunded a further £20: so I was actually £20 better off as a result of being scammed! :T And I didn't return the products ... not that I've used them ... I wouldn't slap goo onto my face when I don't know what the goo consists of. ;)





  • I too have been a mug ... But with me I signed up to be a tester there were 10 places an who ever got the places would only pAy p&p costs .. now I have the same in 14 days I will be charged £87 .. If I refused delivery do you think there will still be a charge I've not received it yet .. also I've seen to return people are being charged £54 not a chance ill pay that I'd rather close my account than give these rib dogs my money

    Just send them a email telling them that you are cancelling the agreement.
    If they then take any further payments. Contact your bank, ask for disputes department and get them to chargeback the payment.
    Might even be worth talking ot them now as well.
