...Indeed, Aqua always decreased the DD amount if you paid off some of the balance early. ...

If the amount collected differs from that stated on the Advance Notice, that would be a breach of the terms of the DD Scheme and would give customers the right to claim a full and immediate refund under the terms of the DD guarantee.

Repeated abuse of the terms of the DD Scheme may result the Sponsor removing sponsorship of that company to use the DD scheme ... which might explain why they stopped. (If they ever did act in the way you imply)

So would they also be in breach if you paid off the full balance between receiving your statement and the DD being "locked"? I've done that more than once and all that happened was the DD didn't go out, which is entirely sensible.

Can't imagine anyone would complain about this though, since it works exactly as you'd expect it to.

Personally I wouldn't use it for anything major that you want section 75 protection on as possibly you haven't got a contract.

If there is no valid contract in existence, then they cannot lawfully recover the money spent.

So I would spend, spend, spend!

There is no breach in the terms of the Direct Debit Scheme if they fail to collect anything. (and similarly there would be no claim under the DD Guarantee if nothing was collected)

A breach only occurs if they collect any amount other than that specified on the Advance Notice.

That's as maybe, but every credit card I have ever had has taken notice of additional payments so long as they arrived before the direct debit was called.

    ie:

1st March - Statement produced saying they will collect £100 on 25 March.
10th March - Payment made by FP of £50
25th March - Direct debit taken of £50 with no notice of change in direct debit amount.

That's how every card I've ever had works.

Then that is a breach of the terms of the Direct Debit Scheme.
You would be fully entitled to request a full and immediate refund from your bank of the amount collected under the terms of the DD Guarantee.

Such repeated abuse by a Service Provider may ultimately see their sponsorship to use the DD Scheme removed.

You'd better report every single credit card provider then, because AFAIK they all operate this way.

If you make an additional payment against a minimum payment Direct Debit, then your Direct Debit payment will go down by that amount. The minimum payment is really a safety net to ensure you don't incur late payment charges. Ideally, you should still make additional payments by other means rather than sticking to the minimum each month.

If you make an additional payment against a full Direct Debit, then the Direct Debit will be reduced by the amount of the additional payment.
    etc

Other companies' T&Cs will be near enough the same.

You're the one that claims they do.
You're the one that has the money taken.
I cannot make a DD Guarantee claim for you.
You will need to call your bank and they will help you, and provide you will a full and immediate refund :)

Me and all the other people in this thread, and many other threads on the subject.

And why would I want to do that?

Should I be upset that they've taken less money than they said they would? So long as my full statement balance has been cleared, as agreed in advance.
