3 mobile misleading customers with ''all you can eat data ''

Options
Especially new customers please check- TrafficSense™ on three website

its the new generic term for fair usage policy which is hidden from all customers. Three has hit the target of luring the maximum number of new customers on the ''all you can eat data'' advertisement. Like O2 ,three is going to scrap the unlimited data soon.

So new customers beware because three doesnt show fair usage policy but will use the traffic sense trick

    I don't see this anywhere.

In the terms and conditions it says:

Does all you can eat data come with any limits? The limit is how much your device can consume – if you were to actively use data or the Internet on your phone every second, of every day, in every month (and we would be worried if you were !!!!) you would, subject to the current traffic management requirements (which vary from time to time), use up to 1000GB per month. So in essence there is a limit of how much data you can actually consume which is up to 1000GB. All this means that you can have absolute piece of mind and enjoy all the internet you need on your smartphone, without worrying.

Surely every internet provider whether that be mobile or otherwise has to manage the traffic in some way. If you read the policy, it simply states that P2P traffic will be speed limited between 3pm and midnight. If you use it often between these times, your speeds may be restricted for 7 days. Is it reasonable to expect to tether your phone then use P2P services regularly?

That said, 3 do have form in this area. My previous contract with them was sold as unlimited data but then on "my3" I had a little clock counting down how much data I had left to use each month because of fair use policy. It's why I laughed so super hard when their sales staff were talking about their unlimited data deals.

There is a bit in the t&c about their traffic management policy and their right to amend it as they see fit.

I think this has only been implemented in the last week or so (I certainly have never heard of it before) but traffic management has always been in the T&Cs so customers are hardly being misled.

Indeed, I don't like this 5% thing. I'm glad I'm not on Three anymore.

I've discussed this with them before, having had the same issue - their online system has a fault whereby those on AYCE data quite frequently are shown that they only have 1gb. When it reaches zero, nothing happens. It's just a system glitch. Mine frequently hits zero and I'm never charged anything.

its not limited to P2P only as it states:

    Tethering.:
even if u have add on for unlimited usage; 3 will block you giving reason below aka labelling u as High data users

    High data users.
    for example:
If you do things like stream a lot of high definition films -watching lovefilm, youtube, bbc iplayer for example

    or download files directly

any other kind of heavy use of internet cuz 3 wants you to check few webpages & email, thats it & better if u dont use between 3pm-12pm:p

its strange cuz 3 sold contracts on all you can eat data plan.

when o2 or orange had unlimited plans they put subject to fair usage policy in their advertisements.at least one could find the fair usage policy somewhere on the adverts eventhough they used microscopic letters.
but 3 clearly states no limits whatsover on their all you can eat data adverts. so i would expect 3 to put all you can eat data*

    *subject to traffic sense

i think 3 have found a loophole where they use traffic sense as trademark & dont have to put them in adverts like the fair usage policy.

if not misled then atleast mis sold.

The amount you can download is not really capped though, so its not really a fair usage policy.

I think the idea is centred on whether you think it's "reasonable" to use the mobile 3G connection as your sole source of internet? I honestly don't think the speed restrictions would be a huge issue to anyone not using the mobile as a sole internet connection.

I honestly think it's taking the mic to expect to be able to download HD movies every day on your phone. Obviously that isn't your view.
