  • To be fair to Three they do offer some good value for money and I reckon that some of you are being a little quick to try and get out of a contract just for the sake of it and some hoping that their very small amount of consumer and contract law knowledge will be enough to get them through it.

    It's not a question of climbing a mountain because it's just there, it's more like a chastisement. Do you think it's right that these companies can disregard their agreements and contracts?

    Has anyone spoke to Three's technical support people?

    My speeds were very slow (as low as 20kbps, basically unusable) and after I spoke to them all was sorted and my internet is now at around 2-4Mbps all the time now.

    As long as you don't mention that you think your being throttled they should sort it out.

    They were actually the ones to inform me a week ago that I was being throttled. I at first had assumed there were mast repairs underway or some kind of maintenance going on.

    I'm waiting for a manager to call me back now, the call center guy was insistent that it won't affect me, but I held my ground. I also pointed out 10.1 D of their terms that says
    Within one month of a
    detrimental variation to your
    agreement.
    You can end the agreement
    within one month of us telling
    you about a variation to your
    agreement (which includes
    your Package) which is
    likely to be of detriment to
    you. You must give notice
    to Three Customer Services
    within that month and your
    agreement will finish at the
    end of that month once we
    receive your notice.
    (A Cancellation Fee will not
    be charged.)
    I think that should be grounds enough, they gave us no warning they were bringing this into effect and it is detrimental to our service we originally signed on for.

    As for the whole handset issue, it could be that it's a gesture of "goodwill" as we may have no ground to cancel the contract but they will let us go if we return the handset (and presumably they will reimburse any payment for it). I'm going to insist they let me keep it, but who knows... Has anyone tried ringing ofcom or trading standards about this?

    I think this whole asking for a phone back, doesn't wash, and they know it but are just chancing their arm.

    Firstly, if you got your phone for a zero cost, then you can almost see where they are coming from, but basically, your contract is with Three providing you with a mobile service, i.e phone calls, txt and data allowances, not hardware.

    But if you actually paid anything for your phone, whether it be £1 or £199, then legally, that phone is yours. And there is no way that Three can demand it back.

    I paid £189 for my iPhone 4S 32Gb on top of my 24 month contract commitment (£35/month), so I bought the phone, it is legally mine, and I would be under no obligation to "sell" it back to them.

    Did they even have any 4S contracts that provided a "free" 4S? I cannot remember.

    Well, I have had my iPhone since yesterday and I came across this thread. Oddly enough I have been having trouble when connecting via my iPhone onto my iPad. .it says no connection but when I try using tr iPhone connectivity is fine.

    I believe that I am being throttle and the only reason I got the phone was so I could tether to my iPhone and not use broadband.

    not sure what I should do now!
