    They have to take me to court before my details get passed on to the debt collection agency where I'll show my evidence to the judge and win.

    Yeah, I told them when I took out the contract "throttling" was not mentioned anywhere in the terms and conditions and that their new trafficsense scheme was implemented May 12th (AFAIK), thus a detrimental change to my contract has occurred which I don't consent to.

    I can cancel now but I'm fighting to keep my iphone which I paid £68 for (not to mention £35 a month for the last however many months).

    I think you actually paid £69 for it. Check for two other 50p transactions on your card. Mine was £69 and I have those plus the £68. A small point but always worth having the figures spot on.

    I am waiting for a call back from a manager to argue it out with, oddly enough the guy on the phone was the most easy to speak to person I have ever encountered at Three.

    How do you get a manager to give you a ring?

    As for the phone, pretty sure you paid x amount for it and its yours whether you cancel or not, maybe ofcom could help or something?

    He said he would raise a complaint regarding the change and pass this to a manager to speak to me about. I would love to know how people got Three to agree to cancel the contract on their first call.

    If I have to return the phone I would be screwed as I already sold it last month and got the new Nokia Lumia 800. I am crossing my fingers and toes this works and then I can get the Lumia 900 early :-)

  • You flummox the call centre people and they then pass you on to a manager (that's how it worked for me).

    I agree, paying x amount for the phone should be the end of the matter. By the time Ofcom gets rolling I fear too much time will have passed.

    If the internet were throttled slightly I wouldn't mind but it's tortuously slow, I often have to click a link, go away for a coffee and by the time I get back it may have finished loading albeit with errors.

    No throttling for me so far.. use 50gb+ a month..

    if anything my speeds are 4mbs higher than when I checked
    a month or so ago...

    You may as well just keep with Three until next year, if that is when your contract runs out as 4G should be making an appearance for all networks and than of course, you'll need a device that is 4G compatible,Apple will do that in about 2 years but of course tell you it's a first.

    To be fair to Three they do offer some good value for money and I reckon that some of you are being a little quick to try and get out of a contract just for the sake of it and some hoping that their very small amount of consumer and contract law knowledge will be enough to get them through it.

    Frontline customer services may no have much law knowledge but you can guarantee they have some clever legal team behind the scenes who know it far batter than all of we do.

    This won't have been implimented without someone in legal going over the plan to check they are within their own terms and conditions.
