3 mobile misleading customers with ''all you can eat data ''

Hi, I agree this is misleading. My mate struggled to get a decent broadband service via his BT line, living miles from anywhere, and this seemed the perfect solution. He' doesn't download much but does watch BBC iplayer due to not getting a good TV servie either. He's now getting "Traffic Managed" meaning he can't watch the BBC after 3pm.
I specifically told the people in the 3 store what it would be used for - and they said it would be ideal for him. Clearly that was wrong.
I've raised the problem with customer services and re-read my contract. there was no mention of this whatsover on the contract as it only appears online. I didn;t buy this online so could not have been aware of it.

I just got off the phone with 3 customer service and they informed me that since the terms have changed (ie the imposition of TrafficSense) they'll let me terminate my contract and not have to pay an early termination fee.
I have an iPhone 4 and I got my contract in January 2011. The person I spoke to told me that if I cancel my contract I have to return my phone. However, I remember reading a member on here saying they managed to keep their phone after terminating their contract with Three because of some reason.
Does anyone remember or know what that reason was? I'm keen to keep my phone since I paid ~£69 for it (or whatever the fee was at the time).
If people are unhappy with this new throttling put in place then I suggest you all call Three and complain at this change in their terms and conditions. That's what I did and it worked. I just want to keep my phone now0 -

Yes, that's what I had read in another thread I think.
I paid around 65-70 quid for the iPhone tho, does that still count as a gift?
What should I say or quote to Three customer support? The man I spoke to was pretty adamant that they never let people keep the phones if they terminate their contracts early without paying a termination fee.0 -

Any idea what is classed as "heavy usage"?
The 5% of users thing ISPs and networks use all the time really annoys me, because it gives you no solid numbers that you know to stay under.0 -

The OP of the XDA Developers thread said he'd averaged only 5GB per month.

The problem here is that 3 is restricting these "heavy data users" to dial up speeds during peak hours (3pm - midnight), which wouldn't happen with regular ISPs.0 -
The definition of heavy usage would be very helpful.0
