What part of DPA? And what does DPA has to do with this?
What Law exactly? Care to quote?

DPA has lots to do with this.

Principle 4 states

"Personal data shall be accurate and, where necessary, kept up to date."

Having opted out, that data is accurate, changing that to opted inmeans its not

Principle 6

"Personal data shall be processed in accordance with the rights of data subjects under this Act."

Having opted-out of marketing by email this does NOT give ovivo the right to opt me back in. Thats why companies must have opt-outs on emails, comes under Privacy and Electronic Communications (EC Directive) Regulations 2003.

Checked my emails and vivos response to my opt-out is

"
Dear Customer
You recently selected to unsubscribe from an OVIVO Marketing Distribution List.
As per the terms and conditions of our service, which you agreed to when signing up for the service, you consented to allowing OVIVO sending you Marketing messages.
In order to ensure you still receive the benefits of the service we offer, you have been added back onto our e-mail service with immediate effect.
Our Customer Services team is available 8am to 8pm Monday to Friday and from 9am to 1pm on Saturdays (excluding public holidays), either by calling 263 from your Ovivo Mobile handset, or by calling 0115 9658347 from a normal Landline. Calls to customer care are charged at standard rates. You can also contact our customer care team by e-mail on **************, but please note for security purposes, we will only be able to support you if you mail from the e-mail address you used when registering. Please always make sure you quote your Mobile Number, Name and Address when contacting customer service

Privacy and Electronic Communications (EC Directive) Regulations 2003.

\The dumbed down version, issued by the ICO states

"From 11 December 2003, the Privacy and Electronic Communications (EC Directive) Regulations 2003 became law and two new rules came into force regarding email marketing.

1st Rule
• when they send marketing emails to you, the sender must not conceal their identity; and
• they must give you a valid address for opt-out requests

This rule actually applies to all marketing messages sent by electronic mail (see ‘electronic mail’ below), regardless of who the recipient is."

Beggars can't be choosers though :)

I'm saving £110 per year. They can send me marketing emails everyday for that kind of saving!

What is the problem with receiving a few mails in return for free service?

You don't have to read them, I never do, they do not intrude on my life.

If someone giving me something for nothing relies on them sending me some unobtrusive mails occasionally (Like the free money from Mutual) then what is the big deal?

Not receiving these mails may put the free service in jeopardy for all of us, if you do not want to receive the mails, read the T&C and don't sign up.
I started with nothing and I am proud to say I still have most of it left.

Not a lot really. The real risk, as I see it, though, is that Ovivo will sell on all the email addresss they've harvested, leading to a huge spamfest.

No doubt we've all used 'special' email addresses, though...........:)

Special emails may not help.....

Further threat is selling of all information for marketing purposes, as the T&Cs now state

9.2 No opt-out to receiving targeted marketing messages is available.................

9.5.6 Supplying selected and targeted marketing materials and media to you by web access, SMS, phone, e-mail or post

I think I'll have to see how far this goes before it becomes invasive.

Saying that I've moved house, can block selected SMS and numbers on my android, don't use their web access, and have blocked the e-mails.

I added ovivo to my blocked email list.

Still a good service though and saving me money.
So you are quite happy to use the service providing they stick to their side of the bargain and provide you with free airtime, texts and internet ....but you don't want to stick to your side of the bargain by allowing them to send you selected marketing emails etc :rotfl:

Rather pathetic IMO
