    Well done for referring it clearly to TS so that at least they might investigate (they should). The matter should also be referred as a complaint to the DVLA if the firm managed to get data of the registered keeper - they were not allowed to.

    have already complained to the dvla they just said they had acted correctly and hung up on me

    Did you expect anything other than that from a co-conspirator- especially on the phone? Have you done it in writing as a complaint to the ICO?

    have complained to the ico they say that the dvla can supply info to anyone who can show just cause for requiring the info and can prove that the info is not going to be mis-used

    hi david do you work for the dvla because i have been told by the dvla that anyone can request info if they have just cause for reqesting it that includes companies or individuals


    Dear esmerobbo,

    I can confirm that a private parking company needs to be a member of the BPA’s approved operator scheme before the DVLA will release vehicle keeper details to them for the purpose of issuing tickets or chasing non payment.

    Our clear understanding is that OTHER companies (anyone, shops, schools, landowners, whoever) can get the data if they can show reasonable cause, but not a parking firm as they MUST be a member of the AOS.

    Esmerobbo's email you quoted was indeed from David Dunford at the DVLA. It is not David posting that, it's Esmerobbo posting a copy & paste of the email received from the DVLA.

    That is correct anyone can if they show reasonable cause be given the registered keepers details.
    However if the reasonable cause is to enforce a parking charge then the company making the request must be on the BPA AOS list.

    They have a V888/3 form especially for this purpose.

    Or they use the EDL if they have it.

    As Coupon Mad has posted that email was sent to me by David Dunford at the DVLA.;)

    hi have just been contacted by trading standard have been told that car parking and select services have admitted to using the b.p.a logo whilst not a member they have had to revise their paperwork, that's it they are not being prosecuted but their paperwork will no longer show the bpa logo
    also a debt collection agency i.e T N C who are members of the bpa got my details from the d.v.l.a on their behalf. anyone know if that is legal?

    No it is not!

    I asked this about Roxburghe and was told that any debt collectors collecting these charges on behalf of a PPC can only get keepers details if the PPC is an AOS member.

    Thank you for your email regarding the release of information to the company Roxburghe Ltd.



    Roxburghe Ltd request information from the records held at DVLA for the following purposes,

    · Requesting payment for unpaid parking charges which Roxburghe will then pursue.

    · Requesting vehicle keeper details to allow their clients to issue a parking charge.



    Roxburghe are only permitted to request information relating to parking charges issued by a BPA, AOS members. Roxburghe are unable to request information from the DVLA for parking charges unrelated to a BPA AOS member.

    Roxburghe are also members of the Consumer Credit Trade Association.



    I hope this helps to explain why Roxburghe are permitted to request information on behalf of BPA AOS members.

    As far as I know, AOS members can only pass on details obtained from the DVLA to other AOS members. So if they weren't members of the BPA (and hence weren't an AOS then yes, I would have thought someone somewhere has breached something here.

    Hopefully HO87 will see this and advise accordingly.
