  • Hi my first post on here i have started the unfair charges prosses sent letter 1 recived statements then carried on with letter 2 then 3 and still never had reply to both letters 2 & 3 anyone had this problem or tell me where to go from here.thanks

    I need some advice please, here's my situation:

    I wrote to my branch of RBS on the 24th Feb 2007 requesting my 6 years of statements. I received these on 30th March 2007 and went about adding up my charges, I was only expecting a couple of hundred pounds at the most. When I was done I was horrified that the charges (minus any account fees) came to £1949.92 so I wrote back demanding my charges be refunded plus interest (total £2623.55) on the 31st March. I used the template letters so I gave them 14 days to respond. Shortly after I received a standard 'We are looking into your claim' letter from the head office in Edinburgh. A few days letter I got a letter saying that I hadn't included the full account details. This is because I initially sent the letter to my branch and hadn't included the sort code. So, I re-sent the letter ensuring my sort code was now present and gave them a fresh 14 days to respond. After 14 days I heard nothing so I sent the letter telling them that I intended to pursue court procedings in 14 days if I still had no response. That was the 26th April and I've still heard no further. The problem is that until I get paid at the end of this month I don't have the spare money to pay the court fee of £120. Bearing this in mind here are my questions:

    1) Does it have any negative impact to not stick to your own time guidelines and take court action after 4 weeks rather than the 14 days I gave them.

    2) When filing with the court for RBS, what address should I use for them seeing as it has to be England or Wales and all my letters have been going to Edinburgh so far.

    3) We have 6 years to claim correct? When does this date begin? From the date you request your statements? The date you first ask for the charges back? The date you file with the court? I ask because this could affect my claim by a few hundred as the first month or two had some of the worst charges.

    Any advice would be gratefully received. I have searched and I am sure the answers to some of this will already be posted but there's so many pages in this thread I just haven't got the time right now.

    Claimed: RBS Charges £1949.92 + £673.63 interest, Total £2623.55. A&L PPI £461.69 + £115.50, Total £577.19
    Won: RBS £1949.92 :T (Settlement, no interest). A&L PPI £577.19!!!

    sorry to be such a dork but where is the spreadsheet - have gone back and forth like one demented over the past hour and can't find it. Am prepared for a 'doh' moment. Feel such an idiot - am usually a quite normal independent adult but am struggling with this

    Wouldn't imagine it would affect you if you gave them 4 weeks rather than 14 days, think it would be a problem if you filed before the time limit you imposed was up.

    Just a quick question, has anyone waited on the full 8 weeks from rbs for an offer? I'm doing just that and have been told I will have an offer by 11/6.

    Hi, I too am just at that stage. My deadline has expired (the 14 days) and their dealine expires next friday. Im wondering if it would be in my interests to give them a ring and remind them. Have you been given an assurance that an offer is imminent? because im going to have to start the court proceedings.

    I called around two weeks ago and was told I would be made an offer by 11/6 which was not negotiable and to mark that date in my diary:rolleyes: , I was also advised to start court proceedings if I did not accpet the offer.
    I decided to go along with the 8 weeks on reading some posts which suggested RBS have been good at refunding charges.

    Yes, I had heard the same. I may give them a ring tom and see what they say.Its a bit disconcerting that they said the offer is non-negotiable but may just have been saying that to cover themselves. Im trying to claim £1166 and would be very unimpressed if they only offered half or less. Cheers and I will let you know if I get anywhere.

    Either way you will get your court costs back so I'd go for it but it is a personal choice ella

  • Hi was wondering if anyone could help me?!im going through the procedure of reclaiming charges from rbos.sent a letter 24/03/07 establishing charges, they came to £1190 plus £187.50 in interest totalling £1377.50. got a reply saying they were considering my claim. i carried on with next step of process when 14 days passed this time reitterating that id take them to court. once again another reply stating they were dealing with my claim. Now another 14 days have passed and the bank is obviously not taking my complaint seriously so what to do? ive heard that i should get in touch with the fos, is there a clearcut time to have waited or should i sit back and wait? any advice would be greatly appreciated, thanks pete
