  • I need help i sent my LBA off on the 11th April they recieved it on the 13th i sent it recorded thing is ive had an email off RBOS earlier saying they looking into my claim it takes 8wks.The LBA deadline is on wed 25th april so now what im on benifits too so i dont need the court fee's ive printed letter 6 off but do i send that now before i go get the county court thing or do i get the county court paper and send the letter off with it im very confussed and dont seem to be getting any help from anywhere i hope you can all help me many thanks people x:money:

    Checked balances this morning to see if my promised bank charges of £694 had gone in but they hadn't (it's only been 7 days since I posted acknowledgement back), plus the a/c had gone over its £1k limit by £8. My bank is a 78-mile round trip so didn't relish the petrol costs.

    I rang Bank Charges Department to see if they could do an IBP (Inter Branch Payment - helps being ex-staff so I can whip them with the jargon!) who said that all the applications are done in order and wasn't able to help - I was extremely polite to her and said I can fully understand how busy they must be, explained my overdrawn situation and thanked her for her help. I then rang my Branch to see if they could increase my OD by £10 and explained I was awaiting £694 any day now. The lovely Clerk said "It's in Lisa!". I am so chuffed.

    My message to everyone out this is be patient and be polite and make a friend out of the person on the phone - they are only doing their job. By trying to understand their position (in other words, empathising) I achieved my goal and didn't rattle someone else's probably already frazzled nerves.

    Hi,
    RBS submitted a defence yesterday and i have subsequently received details from Cobbetts (i assume their solicitors) of the defence and a request for further information form. In the defence it states that 'No admissions are made as to what charges have been debited to the claimant's bank account', and also states that 'The claimant refers under paragraph 3 of the particulars of claim to having provided the defendant with a copy of the list of charges. The defendant has not yet received a copy of this list. The claimant therefore put to strict proof of each and every charge the subject of the claim and must identify in respect of each charge (a) the date the same was debited, (b) the amount of the same and (c) the description applied to the charge'.
    This is rubbish because i obviously sent them a list of charges with dates (but not the description of the charge, does this matter?), so do i need to send it off again or is this a delaying tactic? Where do i go from here? Has anyone had to deal with the same thing?

  • i am waiting for statements from bank, as i have 12months missing, on the statements i already have i have bank charges shy of £6k. i am currently living in my £2k overdraft so the money paid back and quickly is a must!!

    i reckon with the missing 12months i will prob have charges of around £6,800.
    i want to try and get £6k back so i thought about writing to the asking for charges plus interest waiting to see what they did then telling them i would settle for £6k out of court if they pay within 14days, if not i will take them to court for the full amount + interest + charges + loss of earnings.

    have i got the right idea??? i dont want to mess anything up as the money will get me out of **** big style!!

    Yes you are along the right idea, but you can not take them to court for loss of earnings.

    And remember that anything over £5000 then it will not go through the small claims and you might be liable for charges (if you lose), if ness split the amount and file 2 claims.
  • i know about the £5k maximum for small claims, but after reading success story forum i believe if it goes to court stage (and i hope not) i would still win anyhow, it would be more of a president should my case go to court and they lost wouldnt it????
    anyway im gunna try for the £6k fingers toes and everything else crossed!!!

    Hi, I have claimed against Tesco Personal Finance (Really RBS) re charges on my visa card. I originally wrote asking for my charges back on 16 March 2007. I had the statements so I knew the amount I could claim was £240. They acknowledged on 22/3/07 and wrote another holding letter on 4/4. I wrote the LBA on 5/4/07. They wrote back on 16/4 rejecting my claim outright. I have therefore filed with MCOL - on 19/4 - deemed served on 24/4/07. They have acknowledged service immediately and so have until 22 May 2007 ( I think) to reply.

    Does anyone have any experience of claiming fees on RBS credit cards, and whether they are successful? It would be good to have an idea of what to expect next.

  • have had offer from rbs on our second account of the full amount of £5899, as a gesture of goodwill, and have sent back acceptance letter :beer:

    BENEFICIAL c.card = £737.11 REPAID!!SUCCESS:T
    (received standard 'no' just sent LBA) now have been offered half of claim = accepted as partial refund and they then said 'exceptional circumstances''blah blah' and sent cheque for all of it.
    GE MONEY B&Q store card = ?:confused: They will be next:mad:

    MSDW credit card = Offer £232 Took it:j

    LA REDOUTE catalogue = ?:confused: They will be next:mad:

    Hi RC. Took about two weeks I think.

    HELP
    I received another statement this morning for sometime in 2006 which shows I was overdrawn but not when or how much I was charged. The large bundle of statements I received just over a week ago also seems to be like this (Hey, I've been away!).
    Is this some new tactic or have I done something wrong? (like possibly be too dumb to read the statements correctly....:rolleyes: )
