I suspect that may be changing now that they have Cobbetts in on the action.

Certainly if a case goes to court action they will involve solicitors but if you read this thread and the RBS success stories you'll find that many are settled very quickly without the need for court action.

katy3, of course it is your decision if you file on Monday or not but try phoning them and see what they say. Yes, they may well say that your claim isn't at the top of the pile yet and you will need to wait so many days and then you need to decide if you want to wait the length of time they specify.

I had a RBS business account, which was closed with an overdraft outstanding. They have taken me to court and obtained a charge for this. Can I still claim all my charges (and there are many), and deduct it from the overdraft outstanding as the company is no longer trading?

I sent a letter to RBOS on Monday 23rd enclosing charges and requesting £1910 refund. Received a reply on Wednesday saying "considering your claim and will respond to you as soon as possible." Even if they are trying to stall for time, at least they seem to be responding quickly, had no response whatsoever from LTSB and first contacted them on 29th January!!!
    Bank Charges - MCOL – LTSB Current Account £4,603.92 / Settled £5,680.76 /Financial Ombudsman – LTSB £11,715.84
    PPI - Debenhams / Settled - £2243.20
    We're in the money!!!:T

You can claim back the charges but as you say RBS themselves are likely to put any monies reclaimed towards your debt account.

I don't think its so much they are stalling, more they are very busy and do seem to be dealing with claims in order. If you don't hear again its worth a polite phone call.

Hey all money savers, unfortunatly I have the great pleasure of working for RBS and I know that the number of people claiming bank charges has risen beyond their expectations(quite rightly so,I'm in the process of claiming from Barclays!) thus resulting in them setting up a claims department who we now send all enquiries direct to so people should be receiving quicker responses rather than it taking ages for branch staff to deal with...hope this little insider knowledge helps....?!

i'm due to send my letter before action tomorrow but just wanted to know if it's worth giving them a phone call to see what stage my claim is up to? thanks for any advice.
  • Hope someone can help.
I've been an RBS customer for about eight years.About 8 months ago, I lost my job and obviously this affected my financial situation leading to me being constantly overdrawn. I switched all my direct debits to my partners account. But I continued to become further overdrawn due to RBS charging interest. Now finally, ive gone over my limit and they have issued a default on my account.I intend to claim all charges back because its RBS's interest charges that sent me over my limit.Do I have much chance especially with a default on my account?
    Thanks in anticipation

    Hey All!

I received all my bank statements last week, totalled them up and sent the letter telling them the amount I wish to reclaim, and they have 14 days to reply. This is only day 8, but i'd like some advice. Should I contact RBS by phone after the 14 days has elapsed? and also I only put a claim in for bank charges(without interest) Should I have went for interest as well? I am prepared to go the whole hog but did not want to lose out by being greedy!

Any help or advice would be gratefully received.

    Many Thanks:D
