    Personally I am of the opinion of sticking to the timescale I have already laid out. The question is are you willing to settle for less than what you are claiming?
    I think it sounds like a stalling tactic to me how can they say they will be sending a letter out with an offer in 4 weeks!!! seems like they're trying to slow down you claim.

    Stick to your guns and your timescale

    Any help would be appreciated. I am at the threatening court action stage.I posted my letter threatening court action on saturday.On tuesday i recieved my 4th confirmation letter from them acknowledgeing my claim. I now am just waiting for the 14 days to be over befoe i actually proceed with the court action although i am prepared to do this in honesty i dont really want to. Anybody else finding it as difficult as me to reclaim the money ?
  • Hello everyone.

    Recently received my husbands 6 years worth of bank statements and to be fair to RBOS they were prompt with it.

    We went through them and luckily the charges don't come to as much as we thought.

    I'm not completely stupid but still quite confused so I have a couple of questions just to clarify.

    Firstly I understand that standard overdraft charges etc cannot be claimed back and for the first few years on the account my husband never needed to use the overdraft although there was a monthly £5 fee.

    In later statements, he went over his overdraft limit and so was charged £33 which by my calculation is a £28 excess overdraft fee +£5 standard. Most recently the standard charge went up to £6 so the monthly charges were increased to £34 (£28+£6standard fee).

    The problem is that these charges are not listed on the statements as excess overdraft fees but as 'CHG TO 07MAR A/C 1*******' Which is how the standard £5 fee is listed in the first statements.
    Are they going to fob this off as standard charges because they are not labelled as some kind of default??
  • Also a couple of other verification questions.

    He took out a loan with RBOS a couple of years ago and when things were bad the payments were not made. Twice on the statements he was charged CHG UNPAID ITEM
    S/O £66.00
    RBS LOAN ARREARS £38
    What I don't quite understand is does this amount relate to his account because the Standing Order wasn't paid or is it actually a charge relating to the loan i.e would they have added this charge to his loan rather than the bank account if his account wasn't with them?
    Hope you understand my meaning.

    Okay next question.
    At the end when things got really bad the bank told him they would shut his account down a set it to default which he agreed with as neither of us really got what they meant and they dressed it up to be a good idea.

    On his staement there was a listing
    CHG TO DEFAULT NOTICE FEE.
    Is this standard as he agreed or can we add this on to the charges we reclaim??

    Hi just about to send my first letters to RBS,MBNA,Halifax,Amex could anyone tell me do they reply fairly quickly or do you have to wait the full 40 days

    You wait how ever long you have stated in your letters.

    If you have given them 14 days to reply, then thats what deadline you go by.
    Always go by your time table, never theirs.

    I have just wrote to the royal bank of scotland to reclaim my charges amounting to £11500.00 ( yes eleven thousand one hundred pounds :mad: ) on 2 account over six years.
    has anyone has sucsess claiming from them. Any notes of encouragement will be gratefully received.

    DW I am awaiting response from my 1st letter requesting refund of charges - I wish you the very best of luck and although my amount is significantly smaller I know the impact it had on me so i can only imagine yours. Please keep us updated as I am sure many of us will be keen to know how this one goes

    Sheeesh,now that is some lift if you can get all that,poor old RBS will be bankrupt now.:rolleyes:

    Just remember, that money is rightfull yours!!!

    They have never been to court yet, as they can not defend the charges.
