    Thank you Edinburghlass.

This is probably in the wrong thread now, but the letter I received requesting further information states it's '...served pursuant to CPR Part 18 alternatively with regard to CPR Rule 27.2(3)' Is this the Cobbets CPR Part 18 request?

If so, can I use the template letter that esmerellda suggested from Martin at CAG, which states:

'I am not prepared at this stage to answer the CPR Part 18 Request. I anticipate that the claim will be allocated to the small claims track and would not then expect to have to deal with a Part 18 request since these are specifically excluded under Part 27 unless the court specifically orders me to do so of its own initiative'

    Thanks.

I still trying to talk my fiancee into taking RBS to court, but seeing as a lot of you have had a defence put in against you, even I'm getting a little worried. So can you help me.

Exactly how many of you have been to court with RBS defending????

    Hi everyone,

I am wondering if anyone knows if the Moneyclaim Online accepts the Registered address for the RBS? The reason why I am asking is because I went on the website of moneyclaim online and it said that "All defendants have an address in England or Wales where documents can be delivered".

Can anyone advise me if I can still proceed to sue the RBS online?

    Many Thanks.

Use your local branch address provided it is in England or Wales or alternatively use one of the main London addresses.

There is an address you have to use if you live in England.

    Just a quickie

I have been going through my statements back to 1998.

I have a rather odd situation. I have a mortgage and a mortgage servicing account because RBS staff cocked it up when I joined. I have a current account elsewhere and have never had any facilities on this account. Anyway, previously, if I ran up an OD on the servicing account, they would charge interest, but not issue additional charges. Obviously, it was in my interest to sort it out as the cost of doing this was higher, even though the amount was one or two figures.

Back in 2001, they transferred the mortgage to their cente near Glasgow, but left the servicing account in Yorkshire. Recently this went OD but my mother had just died so I had other things on my mind. Anyway, I could afford the few quid interest. Except this time they started to add loads of charges and it snowballed. By February 2006, I estimated that 75% of the OD was down to charges and asked for them back.

Now they are saying that my servicing account is a current account, and their charges are set out in the terms and conditions. On the one hand, RBS treating this account as a current account "entitles" them to issue charges, on the other hand, since they designated it a current account, I can claim the charges back. Will enjoy that. And I do not even need a parachute account.

You'll find that address in the Reclaim Help Thread post 1 which is used for NatWest which is now all one and the same as RBS.

You'll also find there that Monument comes under Barclaycard.
  • Hi. As ex-RBS staff I hope I can throw some light on "Gyle" addresses.

The Gyle is a MASSIVE complex in Edinburgh with various entrances and car parking areas named North, South, East and West which are needed due to the sheer size of the place - it helps the Postman! I wouldn't worry that your post will not reach where you wish it to go - with all the furore over charges, probably every member of staff inside the building will know where to forward your correspondence if it lands at the wrong end.

My correspondence was sent to Customer Relations Unit, Retail Support, The Forthstone, 56 South Gyle Crescent, Edinburgh, EH12 9LE.

    Hope this helps.
