    You need to write back and tell them you won't be accepting this and will be continuing with your court action.
  • I already had my bank statements, therefore didn't need to ask for the RBOS to provide statements.

    I addressed my stage 2 letter to The Manager at my holding branch and delivered the letter with all the back up through the branch's letter box last Sunday 15th April 2007 - as yet I have had not had an acknowledgement of receipt of my letter.

    Is this normal?

    Should I have sent it by post the the head office and not my branch?

    Any help would be appreciated

  • My son has sent the first template letter asking for his money (without interest) and after 3 weeks , has had no reply. He is ready to send the second template letter but should he now use the one claiming interest or just ask for the money without interest again? If he does ask for interest is it a straightforward 8% of the total claimed? Any help would be much appreciated.

    He can send either, the interest won't be included in any offer the bank may make before it goes to court.

    To work out the interest each charge needs to be put into the Interest Calculator separately with the date it was taken and a description and this will give the accurate total.
  • Thanks edinburghlass. I'll get him to send the next letter and not bother about the interest. There's no point in being greedy - he'll be delighted if he just gets his claim refunded. Hopefully they will reply to this letter without him having to actually start court action!

    I would suggest giving RBS a bit of lee-way regarding timings as they do seem to pay out the full amount without court action. If he doesn't hear after the next 14 days are up its worth a pleasant phone call asking them at what stage him claim is at.

    Yes this is normal and your letter may not have even been read by a member of staff yet, such is the backlog in people reclaiming. This is not your problem though and once 14 days have passed you can continue to the next stage. It is not unusual to receive no reply at all throughout the entire process and through court stage as the banks are so busy and cannot keep up with the claims. This does work in your favour despite appearances as you can then obtain a judgement by default in your favour.

    Given the timescale of the entire process it is entirely possible that you may receive an answer to your initial letter at some point during the court stage of your claim. Remember that at that point you are entitled to interest and costs and dont settle for less. Good luck :)
  • I am trying to reclaim bank charges for £3000 from the Royal Bank of Scotland, i received a letter last week saying they are looking into my request. has anyone had any success against them, my account is currently in default as i owe them £4500. If i am successful are they likely to send me a cheque or add a credit to my account
  • Hello there!!!

    I am looking for advice on how to take the RBS to court. Following the site it says to follow the "Moneyclaim" procedure. However this is in just England and Wales. The address for the RBS is in Scotland. Also, looking at the site is says that the maximum claim in Scotland is only £750.00 whereas my claim is for nearly £2900.00. Is there an address in England for the RBS????

    Your help please.
