    Because its over £5000, it will not go through the small claims court and you might be liable for costs, (if you loose), which hopefully you won't.

    So it might be an option to put in 2 claims with the same bank but both under £5000.

    Thats the one my fiancee will be using to take them to court,
    and that address has been mentioned on here before, (thats where I got it from).

    I'm starting to panick a bit now.
    I am currently going through court action with RBS to claim back £3468.88 + £1300 interest + £120.00 costs. They had until tomorrow to put in a defence and guess what. I received a letter this morning from Cobbetts saying they are going to defend the case. Does anyone know what I should expect next????????

    EVEN IF IT DEFENDS THE CLAIM, DON'T WORRY. If you’re one of the few cases where the bank does enter a defence, don’t worry too much, this is pure posturing and in almost every case is simply a way to try and make you settle, or argue that you've asked for too much (e.g. you've gone beyond six years or tried to claim compound rather than statutory interest).

    At this point you’re now in the Court process. There’s a straightforward form called the Court Allocation Questionnaire which you need to fill out and return to Court. The next stage should be a Small Claims hearing date, yet this virtually never happens, as the banks tend to offer a settlement at this stage. If you get right to this stage and want help, it’s worth using the further resources.

    The court will send you and the defendant:
    • Form N150 (allocation questionnaire); and
    • Form N152 (notice of defence).
    Fill these in a requested and send them back, from when the court receives both questionaires back, then a judge looks over the case, (to make sure there is a case to answer), then the court will send you a date.

    Don't panic, you are in the right here and are only getting back what is rightfully yours !!!

    Hi all ,o.k. Ive received a letter from r.b.s. today responding to my claim.
    It looks a pretty bog standard reply....Thanks your for your letter regarding bank charges we are currently considering your claim and will respond as soon as possible.
    o.k. can I now send the next letter? or do I give them some time to respond?

    1. I need address for Morgan Stanley credit card. Are they part of RBoS?

    2. I need address for Abbey National credit card, is it Abbey National or MNBA?

    Hi,

    I sent my court papers to the branch at which my old RBS account was held, not the one mentioned above. All my previous corespondence went to the Customer Service centre in Scotland. I have now received a defence letter from Cobbetts, but on top of this a request for more information stating the bank have not received any information regarding the charges. This is wrong as I have my letters and the responses from the bank to prove this. However, is this because I used my old branch address for the court papers? Do I have to now send all the information requested to Cobbetts? Have I messed up really badly? I was hoping to just have to fill out the Allocation Questionnaire, but it appears I'll have to send everything again.

    Can anyone help on this one? Please?!

    Have a read of this thread and just send them the list of your charges again to keep them happy and fill out the AQ if they have sent it.

    Hi everybody

    I have an old account with Bank of Scotland Mastercard. The account as been closed for about a year, but when up and running recieved lots of charges in late fees and overlimit. Just hoping that somebody maybe able to provide me with the address for card sevices royal bank of scotland.
