There are no time limits required by law when dealing in the small claims court and pre-action protocols (personal injury, prof negligence, etc) do not apply.
If you are confident about your claim, keep to the time limit and sue when the time is up.0 -

Hi there!
Just getting messed about by the banks while trying to claim charges back so looking for some advice. Got list of charges and sent a 14 day letter but got a letter back yesterday from them saying they were sorry I had a complaint and they have 8 weeks legally to investigate it! What do I do - still file at court or contact them again? Please help - don't wanna give up!

Hi,
I sent the first letter to Halifax Plc requesting my bank charges back and they responded with a letter saying 'Please note the complaint handling rules set by our regulator, the Financial Services Authority, gives us 8 weeks to investigate and respond to complaints.'
Are they allowed to do this or is it now time to send the second letter stating that I will take them to the small claims court.
Any help much appreciated.
