OK,
just thought I'd put this up as the majority of questions being asked boil down to, shall I wait because the bank has told me it will take this 40 day/ 6-8 weeks/ any other time they decide or shall I carry on.
So, to recap, the timetable for you to stick to (if you want a quickish result)
1st letter requesting bank statements - they are allowed 40 days to send them to you. So they don't delay make sure you
(a) include a cheque for £10
(b) sign and date the letter
(c) follow the template letter and don't deviate (unless its for credit cards then you might need to reword what the charges are for i.e missed payments instead of going over your overdraft)
NB If you have your account online you can often download your statements, so can skip the 1st stage
2nd letter asking for charges back - they now have 14 days to reply (I would allow 14 days from when they receive it but include weekends)
so they don't delay make sure you
(a) include your list of charges (use Martins calculator); it might be an idea to include the description of each charge
(b) sign and date the letter
(c) follow the template letter (unless its for credit cards/ loans then you might need to reword what the charges are for i.e missed payments instead of going over your overdraft)
3rd letter threatening court - allow them 7/14 days (up to you)
again, to avoid delays:
a) include your list of charges
(b) sign and date the letter
(c) follow the template letter
Filing with MCOL - the court will write to you stating the what happens next.
This can a number of things:
Acknowledge the case
Put in a defence
Settle
If they acknowledge (which most are doing) they then have 28 days to put in a defence.
So, when you receive a delaying letter, ignore it (file it) and carry on regardless.
If they ask you to send you another copy of the charges, do it straight away - regardless of the fact that you have already sent it twice!
Make sure you send everything by Recorded Delivery and keep a list of the dates that everything has happened.
I know this is all on the Reclaiming your Bank Charges Home Page, but it seems a lot of people are bypassing that and coming on to the forum to ask this.

Can anyone tell me if I can claim back the 'late fee' charges (£25 per time) that I have been charged on my credit card account. (Similar to bank charges)0

i recieved a letter from bos after i had sent my first letter and charges
totaling £6783!
saying that they had( according to there financial governing body) 8 weeks in which to deal with my complaint ,but should hear something back in four weeks that was the 12 th march
i received another letter today which said that they are still dealing with my complaint ,but should definately hear from them no later than the 2nd may
should i wait for an offer or send my letter asking for my charges back or i
will proceed with court action
has anyone in the forum had anything similar?

i have sent letters 1 and 2 to reclaim charges and recieved a letter back from the bank(lloyds tsb)saying thank you for letter of complaint and saying it takes between 4 to 8 weeks for them to investigate it do i proceed with the next letter ie, you have 14 days or i will issue court proceedings ?

Everything has gone smoothly with statements etc,
Until today !!!
Has anyone received a letter saying under complaint handling rules
set by there regulator the financial services authority gives them 8 weeks
to respond to complaints. however they will respond in 4 weeks to tell us of
there progress.
Can anyone help with a follow up letter or as anyone had anything simliar0 -

This is a common response and because they have entered you into their complaints procedure. You dont have to follow this timetable and can carry on with the reclaiming process. Good luck0 -
Hi all
I sent my first letter to abbey requesting my bank charges plus interest. ive recieved a reply saying they are investigating my complaint and will take four weeks to do so.
Should i wait four weeks or send my second request letter now threatening court action0
