I thought they only had 14days to respond? I got that from the standard letter I downloaded off here?

YOU have given them 14 days to respond to your claim, you set that dealine HOWEVER legally they have 8 weeks in which to look at your complaint, deal with it and make an offer to you ..

If they do not give u a satisfactory response in 8 weeks you can complain to the financial ombudsman...

Do you understand? i cant really think of how else to explain it...

The 14 days is just a tim-scale that you have set them, they have no obligation to respond to you within that time-scale as they are working to the 8weeks set by the Financial Ombudsman..

Just dont respond to that letter, wait until your 14 days are up and send your next letter, wait the 7 days and then file a claim using MCOL

    Does that help?

Im not very good at explaining!! xx
  • Hey everybody..

Sent the 1st letter to bank (lloyds tsb) asking for charges back using template, i sent it on 26th march 2007

Recieved a reply from bank, them teling me they have ackwoledged my complaint and if i have anythng else to add for me t get intouch with them, if they dont hear fromme theywill continue the investigation with the documents ive already sent (list of all charges)..

Now, do i wait still for the 14 days ive given them already, then send letter number 2..(they mentioned they wil do there best to solve it within 4-8 weeks)
Shall call them and say that the 14 days still stands?

Once the 14 days is up from date they received first letter I would send next letter. Stick to your own timescale not theirs.
    Remember and use recorded delivery.
    Good luck

    Hi,

I received a letter from my bank that they will deal with my complaint no later than April 30th. This is after sending the 2nd letter giving them XX date before taking the court route.

I spoke to one of their customer relations people and was told that it will be resolved in their own time and before 30th April.

My question is do I just wait until then before filling in the court papers and just go ahead with my own time scale? The bank in question is Halifax bank and the amount claiming (+ interest) is £980

Has anyone had the same experience with Halifax Bank

Stick to your own timetable - continue with your claim. They are just using delay tactics.

HI everyody, just a little advice please.

I have a royal bank of scotland account which I pay money into and they pay my standing order.

Now I have missed two of these, as my money has not transferred from my other bank account quickly enough. Now my question is this, having claimed aginst HSBC and won, is it worth me trying to get these two standing order charges back - Total £80.00!.

Or should I just walk away, I have now openned a Co-Op bank account so I dont need this account anymore.

    Any advice would be great.
    Thank You.

I would say you can approach this in the same way as other charges

Started off all was well. They sent a really nice letter with the statements and said 'you may now claim back your charges'. Downloaded the letter from the site and sent off what the charges were. The deadline is 14 days is this Saturday coming. However, received a letter which says - I am just writing to let you know that we have received your complaint - and to say how sorry I am to learn that you feel you have cause to complain. (I didn't complain, I just requested my charges back). It then goes on to say 'We expect our enquiries to be completed within the next fours weeks but we will try to get our response to you sooner if we can'. They also enclosed a leaflet which is entitled 'Voicing your concerns' which says they will update the progress after 4 and 8 weeks. Slightly disheartened here as I thought after the 14 day deadline they had to either dispute or refund the charges.

Any suggestions as to what I do now??

  • HI lea

    Yes - ignore them.
Ignore everything they do to delay things - stick to YOUR timetable. They send a standard letter out hoping it will put people off, so just go ahead on your terms

cheers Golddigger I will. I am hoping they just decide to pay it out and have done with it.

I knew I would end up with a standard letter, but hopefully it will come good in the end
