  • Just had a letter back from the Halifax acknowledging receipt of my claim for bank charges. In it they state that under rules set by the Financial Services Authority they have 8 weeks to investigate and respond to complaints. Can anybody tell me if this normal? Should I continue with the next step (small claims court)? Or do I wait for upto 8 weeks to see their response?

    I too got the same letter from halifax about waitin 4 -8 weeks, I don't intened to, I'm going to send them the going to court letter but I have a problem/ question & I know this prob sound a stupid question but. . . on the letter you can print off it says enter name of court. . . what do i put? do I put MCOL ? sorry for being blonde but I want to get this right & my dad always said if you don't know /not sure ask! sooo please could some1 let me know a.s.a.p so I can send off the letter, Thank you loads :)
  • Please can you help me with this one. I have had a letter back from Halifax reference re-claiming back my bank charges - this reply is after sending my second letter threatening to take them to court if they did not reply in 14 days.

    The response I had was as follows:

    "Thank you for your recent complaint. We are sorry to learn that you are unhappy with the charges debited to your bank account. Please note the complaint handling rules set by our regulator, The Financial Services Authority, gives us 8 weeks to investigate and respond to complaints.
    Our commitment to you is that we will respond to your concerns at the earlist possible opportunity. However, we want to ensure the issues you raised are thoroughly investigated. If, for any reason, we are unable to respond fully to your concerns within the next 4 weeks we will write to update you of our progress."

    Do I just wait now after I have had this response as they haven't actually said no to me!! Because your next step is to take them to a small claims court - but as I said they haven't actually said no - do I wait to see what they say - then if they say no take them to court or do I take them to court anyway?

  • I have requested refund of charges 18 days ago without response.
    I spoke to someone from customer relations today ( after being put through to 3 wrong depts) and was told they have me on their database but no action would probably be taken until the end of April.
    Should I now send the next letter i.e informing them of impending court action, or should i hold off?

    Also does anyone know the address of RBS customer relations in Edinburgh.
    As I live in Scotland I cannot use Moneyclaimsonline.

    Do I have to proceed through my local sherriff court?

    Any answers would be appreciated.

  • I also received this same letter from halifax, after sending in my refund request.

    I am a bit confused about the law in this matter, Does Halifax or any of the banks have the legal right to take 8 weeks to look into this matter,

    It only took me a couple of days to gather the info and list all the charges on my account over the last 6 years, so why should it take Halifax 8 weeks.

    Does anyone know the legal stand on this, as I wouldn't want to jepodise my claim, by applying for court action, if they have this legal right.

    I have had no response to my claim (18 days) and am now sending them a letter threatening court action if they do not reply within 14 days.
  • Hi All

    New member to the forum, have been reading the forums for a while though now.

    Anyway after watching ITV tonight about bank charges, I decided to do the same. Im claiming againt Halifax and Barclays.

    Halifax first - Phoned them at 1 in the mornin for my statements from 6 years back and they was happy to send them to me for £10.00, I thought thats fine, I claim it back anyway. Went through my statements and the total im claiming for is £914. Wrote first letter and nothing asking for money back, wrote another letter after 14 days telling them I will be taking them to court, and 8 days later, they have now sent me a letter telling me they will investigate and they are allowed upto 8 weeks to reply as the FSA allow them to have this much time, but said they will reply within 4 weeks and if not let me know it will take longer.....so far so good, there actually listening

    Barclays - Phoned them just after halifax and they was not happy to send my statements unless I paid £3 per statement, i mentioned the data protection act and laughed he then said its not actually in the data protection act and I said dont worry, I will send £10 to your company and get the statements that way, which I did, a week later I got half my statements, they have the others on microfilm and said they will get them to me within 6 weeks, so far total is about £300....
