How long do RBS have to submit a defence?0
-
Hey Guys, I could really do with some advice, I am at the court stage with the rbs. They have filed an acknowledgement but this morning I received a letter saying as a good will gesture they are willing to pay me £462 out of the £633.00. I have called them this morning and said I will not accepted anything but the total amount and I will be carrying on with the courts, the lady on the other end of the phone said ok and thank you then put the phone down on me, what should I do now shall I just wait for the courts or should I send I letter saying I reject the offer, I really could do with some advise0

Hi,
I am claiming £720 plus stat interest. I have been through the whole letters process and wrote my final letter stating I would take RBS to court if I didn't receive a reply by March 16. I called on March 15 to see if they had decided. They told me the eight weeks story and I told them I had set my timescales and would take them to court.
My MCOL claim started on March 16, the statement saying the papers would be deemed recieved by the defendant on March 21. However when I got home last night, I received a letter from RBS, dated March 16, offering me the full amount of £720. Great news - except I've already started the court process.
What do I do? The court process was started the same day they made me an offer, and it would appear I received this offer the same day they received the court papers. Do I have to accept this offer? Will I now lose my court fees?
This site has been wonderful so far - please help!0 -

In response to the above. I had something similiar. I started court process & this was acknowledged 23rd Feb. A few days later I recvd a letter in post offering full amount (less interest & ct fee) & the letter was dated 22nd Feb. They knew my timescales & if they wanted to stop me going to court they should have sent the letter by 1st class & a good few days before I was due to start court action.
Anyway, I won my claim in full incl interest & court fee. SO i'd say continue.
Good luck0 -
Yes agree - just keep going and you will get the full amount back0

Thanks both of you.
Do I need to contact the bank to explain this or do I leave them to answer my MCOL claim?0 -

Thanks both of you.

In my case I just rang them to advise. Any offer they send normally comes with an acceptance to return. So if you didnt return it, they would assume you werent accepting i'd imagine. So either way i guess. But a phone call would just clear it up.0 -

I won against RBS twice. Once on a closed Natwest account & just today on an open Tesco credit card. The first I heard of winning was when I opened the letter & cheque fell out on both occasions.
I'd filed a court claim on both. Have you gone this far?0
