    Lots of peole have and the general consensus is to stick to your own deadlines and, in the style of Sid James, Carry On Regardless :)

    Your timeframe is very close to mine, as most people have said previously, hold out for a bit. have you sent the 2nd letter? i actually sent letter 1 to my local branch, letter 2 to my local branch and a 3rd letter as i had received no response to the head office in Edinburgh. the 3rd letter was a template i got off another site (can anyone tell me where i found it cos i cant remember!) it was 4 days after sending the 3rd letter that i got a letter saying i was getting all my money back.
    sorry i cant be more specific, but i would hold your guns and either call every other day or source out that 3rd letter.
    you will get your money in the end.

    If they are out of the 40 days regarding providing you with the information/statements try this letter and look at the link to the ICO.

    Hello everyone, advice would be greatly appreciated! I have started to claim charges back from the Halifax, I received a letter from them today saying they are entitled to 8 WEEKS to investigate my claim! That they will rspong fully in 4 WEKKS! Is this true, do I have to wait 8 weeks before I can threaten court action or is this a delaying tactic being used by the bank?

    Stick to you timetable and ignore what they say unless it's an offer of a full refund.
  • hi, i took a £10 cheque into my local branch complete with a letter askin for my 6 years worth of statements last thursday, it is now tuesday and the cheque has still not been deducted from my acount...

    shall i give it a few more days or get on the phone to them?

    I had exactly the same response yesterday as did my sis. I told them I would meet them halfway and that I would give them one further week before I begin court proceedings. I also said that I would accept nothing less than the total amount they have took unlawfully from my account, and pointed out too that its in their interets to avoid court action as I would then request the 8% interest and also the court fees if it went that far, the lady told me that they would be in touch asap and that there was a backlog but that all were being dealt with in order of receipt..
    I'm waiting the week then commencing court action, I feel though that they will reply before then..

    did you do that via a phone call.... when i rang i'm pretty sure i got the duracell bunny that just kept saying "8 weeks", think similar to the freaky disguise used by arnie schwarzennegger in total recall...:confused:

    yep did it by phone call, spoke to a lady called Helen Rawnsley on 08457 253519.. she was a bit funny at first but soon came round..lol. I dont think its delaying tactics, i really do believe that they are inundated and cant handle the strain of it all. its our money though and we want it back.. as for the duracell bunny your probs right..lol
