If they are out of the 40 days regarding providing you with the information/statements try this letter and look at the link to the ICO.

Can anyone give me some advice please, 2 weekes ago I wrote to the HALIFAX asking for the money they have charged me back, after going through 6 years of statements they have charged me close to £1200. I gave them 2 weeks to settle at a reduced rate, but failing that I threatened to take them to court for the full amount.
They sent me a letter after 1 week saying that the Financial services authority gives them 8 weeks to investigate this and respond.
They have said that after 4 weeks they will write to update me on their progress.
This to me sounds like a stalling/brush off tactic. I am unsure where to go now, Do I wait till the 8 weeks is up or do i push on and go the next step of starting the court action.
Any advice would be greatly appreciated.

Im in exactly the same position myself, and I have been advised by the lovely people on here to continue with my own timescale and not to be put off by the banks delay tactics - so thats what I am doing. My next letter is going by recorded delivery today!!!

so what is the actual deal with the "8 week letter".... do the FSA give them 8 weeks in which case how can we argue the toss so to speak??
I know to stick with my timetable etc and i intend to do that but if the FSA have ruled they have 8 weeks then what is the point??0 -
well after a heavy weekend up in Scotland drinking :beer: , i returned back to Surrey last night to find a letter from RBS.
they deem their charges to be fair, accurate and legal but are prepared to pay back the £2358 i originally claimed (without interest as it did not get to court stage). :j
i simply had to fill in a small form agreeing to the amount i am getting and post it off (done that 1st thing this morning) and they will BACS payment the funds into my account
thanks to all on the site for help and advice, i will post a message in the suceess stories forum once i am in receipt of the money.
time to cancel that £900 overdraft down to £200 and i have vowed to not get any more bank charges ever again

Hi everyone.
RBS received my 1st letter requesting charges on 15th Feb. Sent off 2nd letter which they received. I've now given them just over a weeks grace as they seemed to be paying out quite quickly. Called them up today to see what was happening with my claim only to be told that they have now been given 8 weeks to deal with these claims. Is his just a delay tactic or has the ruling changed. Do you think I should start court action.

Delay tactic - get your claim in
and get them to pay you the stat interest to which you will now be entitled

I claimed for £715 and RBS sent me a letter yesterday confirming that they will pay £715 (this doesn't include interest). I am so happy, it was very quick only took 14 days from them to send me the offer and I'm off to post the reply.
Yipee soon i will have £715 less debt! :j
RBS also said they won't close my account
