Got a letter from RBS on sataurday which was dated 7th jan which i thought was very strange as was a month late.
They offered me the full amount of charges back but the problem is do i accept or do i decline as i already have them in court via MCOL and they have acknowledged the claim already?

The same happened to me and Natwest. Their offer was dated 02.02, posted 08.02 and received 09.02. However Court claim went in on 31.01 and was acknoweldged by them on 08.02.
I think they type these letters and put them in teh envelope ready and sit there waiting to see what we will do next. If we apply to court, they send the letter.
My offer was £30 below what i was asking, but because i have paid £120 in court fees, i wrote to them yesterday declining their offer and continuing with the claim. I put a bit in the letter bascially saying that if they are willing to pay me the £120 costs, then i would re-condsider the offer.
I would write back the same, it cant do any harm.
Good luck:rotfl:"Penny Pinching Winch"

Forgot to mention, did you keep the envelope. I always keep the envelopes as on the back it proves when the posted it. I suspect (i am sure someone more knowledgable than me would be able to confirm this) that you could use this as evidence if it ever did get to court, that they are wasting time. As the letter is dated in 7th Jan and posted sometime in Feb!:rotfl:

pigsmightfly wrote:Well sent Mint the "threaten court" letter and it's the 7th day today and heard nothing.
Going to ring them tonight and see what they say and will start court claim in the morning.
No reply to my telephone call so filled in the form on Moneyclaim today!0 -
Also, wrote to RBS on behalf of my partner regarding 2 credit card accounts he had with them a couple of years ago which are now closed.
Had a reply off them saying they have located his account details and will send statements within 40 days so if anyone is in doubt about writing off about closed accounts, go for it - what have you got to lose.
Just waiting for the statements now then he can get some money back :j0 -

And I am wondering now how to proceed as I have been offered 4Xthe asked amount which is running through the money claim system at the moment. £90asked- £348 offered!
I wonder if they got cold feet or if it is just a case of confusion!
Because it also looks like someone up there has mixed up my account and the asked amount with my pertner's and my claim for our joint account (£368) - the letter has been clearly addressed to me and stated mine and not the joint account number- which is the offered amount -10 pounds!
What shall I do? Accept the offer and pull back the money claim-is it possible or wait and see what happens? The time for court action on joint account is this week!0 -
Hiya Diamond,
If you recall, which im sure you dont as there are many people on here, i last posted about 14 days ago.
I sent my second letter via recorded delivery to St Andrews requesting a refund of charges on my account. Unfortunately i have not heard a response nor acknowledgement.
I have been reading comments affter i last posted. It seems like MSEr's have gone a little trigger happy after being in a similar situation as myself. They have taken action and appointed MCOL onlyto realise RBS has posted out a response which came a little late.
I am wondering if i should wait?
Call to see the progress of my claim?
Call to see if they are in receipt of my claim?
Thanks for the help in advance (i owe u a diamond ring)0 -
How could I forget you
I hope you sent the letter to St Andrews Square and not St Andrews where it might languish amongst all the golfers up there.
I would agree with you, I think RBS are making good offers and it would be a good idea to give them a ring and ask if your claim has been looked at as yet.0 -
Yes, i sent it to the square.
Thank you sweets, i will let you know how it goes.0 -
Hiya beautiful (not flirting honest!)
Ive called and spoke to very kind representative. He said he is in receiptt of the claim and will dig out the paperwork. Once he peruses the documents, he will call back tomorrow to confirm of any updates.
As a general note to the posters, it is advisable not to get too pushy with the bank i.e. litigate the matter as soon as the timeline is over.
Be patient, allow the time to pass and then possibly follow up on an amicable basis.0
