I've decided I will continue claiming all of the refunds and not half! £270 is better than £135! :p

I still don't undertand how they can ignore half a dozen charges when I did not get them refunded?!?!?!? Does anyone think that this will get thrown out of court if my charge amount is different from theres?
Or should I just claim for £270 when going to mycol?

I have 3 lots of companies that I need to take to court this week ... can't afford all 3 so 2 of them will have to wait 3 weeks until I can. they are all around the £300 including interest but that's still £90 for mycol costs.

I was wondering about the FOS route... but apparently they don't pay interest but yet I've seen a couple of threads saying they did get this refunded also?!??! anyone done this with RBS or another organisation?

I'm claiming from Simply Be (catalogue - still not heard about statement copies but they've cashed the cheque a month ago; Capital one - refunded half back on closed account (?) but I've said will partially accept (& can you send cheque :D).

Has anyone had RBS say that your amount of charges is wrong but yet your statements say something else and if anyone went the FOS route?

Hi everyone ! This is my first post so I would like to say hi first of all, and a big thank you to everyone that posts here, as I have received an offer from RBS for nearly the full amount of what I am claiming back  So thank you everyone without this forum I would have never had the guts to claim back what I did :T and thank you Martin you are a genuis !

The problem I have is with my boyfriends offer. I wanted to see what everyone thought about this situation, we both started claiming back at the same time and recieved our offer letters at the same time, I got nearly the full amount, but my boyfriend was only offered £670 out of a possible £1407  I have been reading through the success stories on the RBS thread and mostly everyone posting has been offered near to the full amount, I just dont know what to do next.

The thought of court and stuff scares me but with the help of this site, I would be able to do it, its just the money for the MCOL claim as well, we have two little ones and I only work part time.

Does anyone think it would be worth my boyfriend calling RBS and speaking to them about this tomorrow ? Or just go ahead with the claim ? He is quite shy about confronting people as well, its me who has done all the claims and written out the letters etc.

Help ! What do you think ?

    Thanks in advance

Hi & welcome. Firstly was the £1407 total charges only or did that include interest? Banks will only offer charges & not the interest, thats awarded by the courts if it gets there.

If you dont fancy the court route then try give them a ring & ask them to re evaluate it, see what response you get to that then if still no joy drop that your going to get in touch with the Financial Ombudsman, if that doesnt work then do it :D

Have you written the letters on behalf of your fella or have you done it & he signed etc?

thank you for your reply :)

The 1407 is without interest, I didnt bother to add that in at the time of claim, it was a little more but in the offer letter they advised they didnt pay out service charge so I deducted all of those and got 1407.

I had written out all the letters for my b/f and he signed them, I used the templates on here. I will get him to call them tomorrow on his lunch break, to see what they say thank you

concerning my posts further along this thread - I don't know whether to start MYCOL on RBS or write to them again... I sent a LBA with copies of my statements as they have missed off several saying they were refunded but these were not... I have checked it several times.

How much do I request... the amount they say? - I guess that would be 'safer' or the amount I came up with?

Also people have said they got letters saying that you have to wait 7/8 weeks and they pay out.. .is this after starting mycol or before? should I write again saying I want the full amount and give them another chance. As all I got was another letter saying half only.

    What do I do?

I have 3 others to go through mycol and can't afford it so I need to choose one for this month only I was going to do Capital One (I've not heard anything from the 3rd one as yet - where as Capital have said no and I've sent a lba).

    any suggestions?

thanks for any help you can offer guys!

wiggy nut i got my offer 8 weeks to the date of when I sent in the first letter saying I will take to court etc, it was worth the wait for me as they offered 90% of what i asked for, sent confirmation letter away today, so just waiting for the money to be paid in now

Re my earlier posts about my OH, he called in today to be told RBS will re-evaluate the claim as they had offerred so little :j then a manager from the cust relations called my OH and said she didnt have a note of any of the letters or statements we first sent off  could we fax them through again and she would take a week to get back to us. I think they have lost his information to be honest and just gave a figure and hoped he would be happy as they didnt have anything to go on. I will be organising all that tonight, plus a nice covering letter stating they have already had they 8 weeks set out in the FSA guidelines to deal with complaints, and we are letting them having another :p

I'm getting fed up with RBS! I've had overlimit charges every month for the last 3 months.. 1 was because a company took money from my card despite the order being cancelled... then the 2nd time was that a duplicate payment went through - not down to me! this month I was told to pay £35 to cover the previous months overlimit, this was on top of the normal payment I make each month.. but the guy was £5 out and now I've got another charge?!?!?!?!
Whenever I call them up to ask questions as to why this is they say that I didn't really call up previously and they keep repeating that I should have called them... I DID!!! which is the whole point of the call in the first place! It's like talking to a brick wall. And one time they said I went over on purpose... eh? why on earth would I purposely go over a £5 which then costs me (now adays) £12 on top.. sorry but I don't think that's logical and if I did make an error fair enough but not if it's their error or another companies... then I don't think I should pay for it or get told that I'm a lier!

Can I and these charges too or is it too late?

I think I'll send one more letter to RBS and start mycol next month (wont say that in the letter though) and do mycol for my (now closed) Capital One card.

Oh well... get there at some point I guess... I'll keep plodding on! good luck all.

Is there any way you could contact the companies that wrongly took funds out of your account, if you are getting no joy with RBS ? I work for a bank and we always look to see if any charge refunds have been given in the past, and if so we ask them to contact the company. A lot of companies do pay out of they have made an error, as you say why should you pay, it isnt your fault  If not I would defo do the claiming back from RBS, its pointless ringing the branch and speaking to them, have you written out your letters ?
