    In fact RBS have consistently made an offer in the 8 week period that they say and I'll shift this into the RBS thread where you can read of plenty of success with RBS.

    lyndsay23, as your account is in a debt situation, any monies reclaimed will more than likely be paid into that account which will of course reduce the debt you owe the bank.

    I have an ongoing claim with RBS and having filed with MCOL, they dragged their feet & acknowledged on the last day, then again waited the full allowed time before submitting a defence.

    I then recieved the usual Cobbets letter asking for extra info blah blah blah (even though I had supplied RBS with a break down of my claim with photocopied & highlighted statements etc... and after asking around on here, I decided to ignore Cobbets & only respond to any court requests.

    I then recieved an allocation questionaire, which was filled out & returned to my local courts with another £100. I have recieved a copy of the defendant's allocation questionaire from Cobbets, which goes on to state that I did not send them the info they requested from me blah blah blah...

    At what point should I send the courts a copy of my statements with the breakdown etc? Will they request it from me prior to the court date? Do I just turn up with it?


    Anyway, another twist came in the form of a letter from RBS head office, with the usual about not admitting to my claim, and their charges are fair etc.. and offering me a settlement as a goodwill gesture of circa £2300. However, my claim was for nearly £1000 more due to interest, and I've also paid out the court fees, which makes me reluctant to settle out of court, but rather see it through till the end.

    I have read on here that I could accept the "goodwill gesture" "without prejudice" and continue with my ongoing court case to claim the remaining balance. This to me sounds like the best option, as I would not be as worried about loosing my case if I can still walk away with the £2300 goodwill settlement (that's assuming they can't retract the payment in the event of a lost court case!)

    Please can someone advise? How do I progress from here? A letter to RBS to accept without prejudice?... are there any good template letters?

    Any help would be great! :)

    I can only point out what Martin and a whole bunch of other consumer experts keep saying - don't let the bank panic you - thats the idea behind their responses. Go back and read the advice page especially the "going to court section:http://www.moneysavingexpert.com/reclaim/bank-charges#court

    If you asked around on here you would have been told to send them your list/spreadsheet of the charges you are claiming but you decided to ignore?

    Accepting a "goodwill gesture" without prejudice and continuing to court for the remainder is different from accepting an offer of your full claim and continuing to court for the interest. You can go back to the bank and suggest you will accept the £2300 and ask that the court fees be added to the £2300 as you had already paid this before they said they would settle your claim.
  • Got my letter on Saturday offering me the total amount claim (£720).

    After reading on here I decided to give RBS the 8 weeks after asking for the charges back and they came through after about 6 1/2.

    Just waiting for the money to come through now, anyone got an idea how long this usually takes?
  • well its finally arrived, we were claiming £2046.77, they have offered £1016 and we are planning on refusing it and called the bank to say that, we have just been told that its non negotiable and that we will now have to start court action! eeeek should we just accept it?

    From what Edinburghlass has said, the interest shouldn't be taken into account until you get to court as this is only what the court would award ie don't use it as a bargaining tool. It's up to you if you want to accept it or not, the way I see it is it's money you weren't expecting so everything is a bonus but everybody's circumstances are different.

    Hi all,
    I was just wondering if anyone could help me out, ok well i get my child tax credits in the bank 2moro, well today officially (tuesday) and have an overdraft which i am upto the max, but i cannot go over this.
    Because of this they are charging me £15 p/month, now this is taken out of my benefit money as i do not work.
    I rang the customer service section of Royal bank of scotland and basically said to them that i was getting charged the sum of £15 tomorrow, and it was coming out of my benefit money which is for the children, therefor i cannot afford for them to do this, which of course is true, but she said you will have to ring your branch in the morning and speak to them.

    Now i was just wondering what is the best thing to say to them?? and will they give me this back??

    Any advice would be greatly appreciated
