    i think i was burying my head in the sand before i checked the amounts of money that RBS have charged us. in a 10 day period in march 2004 we ere charged £350!!!!!

    altogether they owe us just short of £4000! it is scandelous that they just take the money out of your account, disgraceful!

    fingers crossed that we dont have too much trouble. heres hoping.

    Sent my letter off to RBS on 1st May for £3907, sent second letter 3 or so weeks later. Not been to quick in sending letters as everyone on here seems to say RBS will come through with offer, anyway thought I'd give them a ring yesterday (customer relations unit) and they said my claim had been looked at and I would receive an offer on approx 27th June (8 wweks) so they do seem to be dealing with claims if you give them time and they were very helpful and easy to deal with on the phone. Fingers crossed now for full amount.

    Good news all!!!! I got the standard letter saying looking into claims dated 23rd May. Reading other posts, I thought it good to leave them to do their business for the 6-7 weeks they want. I called today (14th June) for an update and the lady on the other end said that they had looked into our claim and were offering us the full £5000 for one account and £2500 for the second. She said the offer letter would be sent out before 19th July (which was the latest date they could send it) and all we had to do was sign and return and the money would be in our accounts within 10 working days. Hopefully we have a result, but we gotta wait for the letter to hit the doormat before we get too excited!
    Timescale for those interested:
    1. Letter 1 asking for statements sent at the 26th April
    2. Letter 2 sent asking for refund and charge particulars sent 21st May
    3. Received standard 'looking into your claim' letter dated 23rd May
    4. Phoned 14th June (0800 0155 035) and told claim being refunded and to wait for offer letter to arrive before 19th July

    In total it will be 8 weeks and 1 day from when we received the standard reply from them. At no point did we threaten court action so it backs up that RBS are quite reasonable if you give them the time they want. Will post when we ACTUALLY get the offer letter. Let's hope they don't let us down now.
  • Got a complicated story here! I got my statements and asked for 4552 back at beginning of April, then i realised that in Scotland you could only go back 5 years not six, so i have waited until two days ago, never had response, so i filed 8 small claims, going back only the 5 years but adding interest, they now total 5500, but i think i have added in charges that may not be allowed, but i am too late now, the claim has been submitted, help! what will happen now?

    Sent my first letter to RBS requesting my Statementson 28 Feb 07. Received them 3 weeks later together with cheque for £10.00.

    Wrote first letter on 30th March demanding £2530.00 charges plus interest of about £900.00 and received their standar 'considering my claim' letter on 10 April.

    On 17 April I sent them the 14 day court action letter. However, from reding this forum i decided to wait the 8 weeks.

    Received a letter last night stating usual blurb about charges being fair ect etc etc, however, the have offered £1910.00 as full and final settlement.

    I have decided to accept as the charges were made 5 years ago when i was in fanancial difficulty and 2K is a bonus considering a few months ago i was not even aware of the costs.

    Time to book a good family holiday i think and spoil my wife and daughter.

    Both myself and my husband were sent offer letters yesterday for the full amount of our claim minus the interest and court fees. I sent back their mandate to them, that you were supposed to sign as "full and final payment" and told them that this was not in any way "full and final" and that I wanted all the money back with interest and court fees but that I would accept their offer as "Part Payment" in the meantime!!!!

    My came to £1593.66 supposed to be £1951.94 + court fees

    Hubby's £4425.00 supposed to be £5625.46 + court fees

    Has anyone else been through the same circumstances? Have you been given a part payment? Do they eventually pay up before the court date the full amount asked for? How long does it take for any part payment to come through?

    The reason that I want it all back is because we had a near perfect banking history with the RBS until I had a car crash 3 yrs ago. I couldn't work and needed constant care which my hubby had to give me and due to this the RBS defaulted us on loans, mortgage etc. They wouldn't let us remortgage through them and we ended up having to go through one of the higher interest mortgage companies and are now crippled with debt as a result of this. I need to reclaim ALL of the monies back as we need it to try and clear our feet a bit and also due to the principal of the matter and the fact that it is OUR money that we want back, money that could have helped us out a lot at a time when we were at our lowest and they decided to screw us over! NOw it is time for revenge!!!

    I would love to hear your story or any advice that you could give us to help us.

  • Has anyone managed to get their money back? We live in scotland and the laws are different here.
    can we only claim up to £750?? i have bank charges amounting to £2046.77! also we can apparently only claim for 5 years worth, is this true? why is that? are we scots not worthy? lol
    Anyone tried and won? What happens when you have to take them to court as we have so far done everything else but dont see the point if its only going to be for £750.
    We have had an offer of £1016. from them but its still less than half of what we claimed. not sure if we should just cut our losses and take it.
    Any help would be appreciated

    and the previous posts about RBS in this thread and you'll find RBS will negotiate so give them a ring and see what they say. Should they not play ball you can always put your claim through the FO, have a read of Martin's article regarding this.
  • Have also received the same message and our letter should have been sent out on the 8th June now saying the 18th and as RBS seem to be paying up will wait to see what they offer.

    i followed martins advice with the step by step letter sending proccess. but had to go through with court action in the end, and eventually send the bailliffs round to the RBS in sheffield to pick up my money. when they ignored my letters i filed the court papers against my branch of RBS in sheffield. after they recieved the court summons for charges plus interest i recieved a letter from HO in scotland offering me all charges back less £100 (WHY less £100???) (£3195) minus court fee i d had payed (£120) and interest (£920). but they did not file an aknoledgement to the court. so i asked moneyclaim online for judgement by default for the lot. and got it. had to send bailliffs in eventually as still wouldnt pay.

    from sending my first letter to me recieving my cheque from sheffield court baillliffs, the whole process took about 3 months. just stick to your guns and dont wimp out half way through like my mum and sister did. they accepted offers of 3/4 of there charges back cause the court process scared them.
