Both myself and my husband were sent offer letters yesterday for the full amount of our claim minus the interest and court fees. I sent back their mandate to them, that you were supposed to sign as "full and final payment" and told them that this was not in any way "full and final" and that I wanted all the money back with interest and court fees but that I would accept their offer as "Part Payment" in the meantime!!!!

My came to £1593.66 supposed to be £1951.94 + court fees

    Hubby's £4425.00 supposed to be £5625.46 + court fees

Has anyone else been through the same circumstances? Have you been given a part payment? Do they eventually pay up before the court date the full amount asked for? How long does it take for any part payment to come through?

The reason that I want it all back is because we had a near perfect banking history with the RBS until I had a car crash 3 yrs ago. I couldn't work and needed constant care which my hubby had to give me and due to this the RBS defaulted us on loans, mortgage etc. They wouldn't let us remortgage through them and we ended up having to go through one of the higher interest mortgage companies and are now crippled with debt as a result of this. I need to reclaim ALL of the monies back as we need it to try and clear our feet a bit and also due to the principal of the matter and the fact that it is OUR money that we want back, money that could have helped us out a lot at a time when we were at our lowest and they decided to screw us over! NOw it is time for revenge!!!

I would love to hear your story or any advice that you could give us to help us.

    Thanks, Angela

Angela, from my experience of reading various bits and bobs from this site you are not entitled to the interest unless you win in court. You can claim your court fees back then. If they have made you an offer of the charges you incurred minus interest that is better than many people get so I would accept it.
I can see why you might be angry as they have contributed to what went wrong after your accident (hope you are fully recovered by the way) but would £6k be better than going to court and possibly not getting a penny?
If you do decide to fight it all the way then I wish you luck.

    Hi,
im after a little advice, i sent a letter off to the royal bank of scotland to ask for my charges back - which totalled £1047, i received a letter 5 days later saying, thanks for the request, due to the amount of requests were getting this will take 6-7 weeks! Are they allowed to take this long?
  • Hi,

I have this week received back £290 (amount I asked for) from Royal Bank of Scotland. I sent first letter 13th April asking for charges back and only received one letter saying they are currently considering my claim on 19th April. Heard nothing after that until this week got letter saying "they think their charges are fair blah blah but as a gesture of good will they will pay me. I would let them have 7 weeks. You'll get letter same as me after that time :D
    :D

    Successfully claimed so far:
    Co-op Credit card £75.00
    Cap One £200 for O/H
    Barclaycard: £108
    RBS: £290
    Cap One: £126
    HSBC: £338.50 for daughter.

    Hi,
I'm reclaiming form RBS as well at the moment. I sent the first letter and eventually got "we are considering your claim" then nothing for about six weeks so I sent the second letter (the "or else one" lol) and still nothing for another fortnight so I've lodged the claim with the Moneyclaim website. Interestingly I've had two letters this week, one from the court giving a copy of RBS' statement that they intend to defend the claim and another from those nice people at RBS which is headed....
THANK YOU FOR BORROWING WITH US!!!
(The capitals, the bold type and the exclamation marks are all theirs, not mine.)
Well, with having already taken Martin's advice and opened a parachute bank account it now looks like I may be in the market for a new personal loan too!
Let's hope all these claims are successful but in the meantime I wouldn't count on any kind of consistency from our friends in the Banks.

Hi lyndsay, just to say moneygrabber is right, rbs are paying out after about 7 weeks,we sent our letter asking for charges back on the 10th of april and received considering your claim 3 days later,we rang them after 14 days, and they said they had 8 weeks,so we were going to send lba but after reading posts on the rbs thread some of which were from edinburgh lass ,which said rbs usually come up with the right offer if you give them time,so we decided to wait, and after 7 weeks we received offer of full amount less interest which we've accepted .GOODLUCK

Cheers for your comments guys, im going to leave it for a few weeks and see if i hear anything, im off on hol 7 weeks today so you never know i might get an offer just before i go (which will come in handy!!) just one other quick thing - will it matter that i dont use that account any more? i got into a bit of a mess with them so i went to a debt management place who are paying them monthlty on my behalf (im paying them) and so i opened another account. But my account still comes up on my online banking so i gather they havent closed it. (all this was in the last 2 months) xx

I made my claim 3 weeks ago and I have heard nothing at all despite sending a follow up reminder. The whole court thing is all a bit worrying.

yeah mckat im not that keen on the whole taking them to court thing, it is a bit worrying! its just frustrating as i know lots of people who have claimed bank charges from different banks and they have had their money back with a few weeks (usually 3-4) at the most!!
Cool orangelily8 at least you know your going to receive something, i hope you get your full amount!!
