    HI,
I was told on the phone last week that they have ten working days in which to put the money into your bank after you accept the offer.
Just a note of warning to people.....my eight weeks with the RBS was up nearly two weeks ago and I have still not received an offer. I phoned them and was told first that they had ten working days from the end of the eight weeks to fix it...which when I phoned the FSA I found to be nonsense. So i made another phone call and was told that they accepted that they had broken the same laws they had preached to me and an offer would be sent out immediatly and someone would phone me to clarify the position. A week later I had neither so I rang again to be told that an offer would be sent second class the following monday...another delay. When you consider that I will have to reply and (if I accept) wait another ten working days for the money it could run to fourteen weeks!! Needless to say I have today reported this to the Financial ombudsman and they are very interested into looking into it for me!! Has anyone else had anything similar and has anyone any advice!!?

    Hello,

I read with dismay Leona78's message about maintenance charges. I was intending to claim hundreds of pounds from a student/graduate royalties account as I've been charged a maintenance charge of £28.00 a month for approximately the last 3 years (as well as the same amount again in interest  )

Is there no way I can reclaim these, £28.00 a months seems a lot

    Thanks Jen x

Hi, we claimed charges back from rbs(just waiting for them to pay them now),we also had maintenance charges of £28 each, some were when we had a royalties gold account so we deducted the royalties gold fee of £12 from the £28 and claimed the £16 .From the date we changed to a current account we have claimed the £28 charges, they are paying the whole amount claimed less interest! hope this helps you.
  • Hey there, just looking for some advice as i'm not sure of how to take the next step...

I've been waiting over two weeks now to hear back from my bank (The Royal Bank of Scotland), regarding my charges which total £1480.00... I sent the letter threatening court action on the 21st of May without a response yet...

I know its time to take the next step, but with this all being new to me, i'm not sure how to start things off... I'm in Scotland and i've heard that I may only be able to claim up to £750.00 through the small claims system, is this true? And if so, is there another way I can go to try and get back all the money owed to me...

    Help... Please...!

    Cheers,

    Gra

Claims in Scotland over the £750 small claims court limit are a bit of a problem.

The only alternative to the mainstream courts is the Financial Ombudsman. It is free of charge and handles everything for you. They also fine the bank £400 for each complaint they receive. However, you cannot refer your claim to the Financial Ombudsman until you have been dealing with the bank for 40 days, and it cannot make the bank pay up or set the level of the settlement like a court. Despite this, their success rate is good. Being financial experts, they can also threaten to ask the bank some very awkward questions.

However, if the Financial Ombudsman is unsuccessful, you can still take the bank to court. In view of this, and the amount involved in this case, you can use a combined strategy.

Firstly, use the the Financial Ombudsman. If he can get all your money back, good. If he can't, as long as the remainder is £750 or less you can still use the small claims court to get this back.

Please read the Reclaim Bank Charges Help thread for information and the Reclaimed Bank Charges Success Stories and Reclaimed Bank Charges Success Stories II threads for inspiration.
The acquisition of wealth is no longer the driving force in my life. :)
  • Thanks, going to try going through the financial ombudsman...

    Cheers,

    Hi All

In my last post I inform you that RBS had offered me full settlement on my 4 closed accounts to the sum of over £4000. Sent paper work back on the 1/6/2007 and came home today to find payment in full in the post, 10 days not a bad turn around. Keep at it, its your money.:j

    Good luck to all.

You can in fact claim up to £1500 via the courts in Scotland under the two tier system there but as regards RBS if they have given you a date that they will reply to you by, invariably they will make you a reasonable offer on or around that date.

Obviously as you can read some user's have been unlucky but a significant number have had an offer of their full reclaim. Give them a ring and see what they say and at what stage your particular claim is at.

i have sent the bank the letter along with calculated charges !

i have received a letter back from the royal bank of scotland

Thank you for your recent letter regarding the fees applied to your account.

We are currently considering your claim. Given the work involed in assesing your claim we anticipate that we will be in a position to respond within 6 - 7 weeks, but will endeavour to do so sooner if we are able to .

can anyone let me know if this is correct or are they just stalling for time and should i send in letter 4

    thanks all

Its worth waiting on the RBS responding as they do offer the full claim within the 8 weeks timescale they are allowed by the FSA.

I'll pop this in with other posts regarding RBS where you'll find most people have received their offer in due time.
