I had an email from Peter Beasley today the BPA Compliance Manager, the outcome is basically that they are not going to persue UKPC as they were NOT informed by WDC that the roads were being adopted, and that they believe UKPC did not operate outside of their guidelines.
However he went onto say and I quote "UKPC have confirmed the above, and were only made aware of the problem when contacted by motorists and the local press. They have confirmed that they have cancelled all relevant parking charges dating back to the adoption date and refunded all those where they have contact details. They have now removed all signage from the adopted roads."
So it would be interesting to see if I can now fine some folks that have paid and see if they are / have got their money back and to also see if DRP are still persuing.You may click thanks if you found my advice useful0 -

I am a student in Leeds and I park in a housing estate next to the uni and have been doing for the last 2 years. All of a sudden, UKPC have taken over this housing estate and have started issuing £90 tickets out to anyone that parks there (£60 if you pay it in 14 days).. I parked here and got a ticket, which i appealed for. They replied back saying its a residential area and i would need a permit if i wish to park there. There are also signs up which i didn't see at the time. My ticket runs outs on the 11th so if i was to pay i would need to do it by then. Im worried on what to do! I've read up and can tell that all of you will say not to pay it but i need reassurance. I have rung the police about it and they have told me that private companies ARE allowed to issue tickets, and if there are signs up then i will need to pay it?0 -

Firstly, the legal stuff.
Any warning signs are usually so badly positioned and worded, that they won’t have created a fair and legally binding deemed contract between the car park owner and the driver in the first place. (The Unfair Contract Terms Act 1997.)
Even if there is a contract, all the car park owner can claim from the driver in damages for any breach of contract is what they’ve lost as a result. If this is a free car park or they paid, this is £0.00. By asking you for more, which is unreasonable, it’s become an unfair contract penalty, which is not legally enforceable. (Dunlop Pneumatic Tyre Co. Ltd. vs. New Garage & Motor Co. Ltd., House of Lords, 1914.)
Only councils, the police and Transport for London can impose legally enforceable fines or penalties. Private companies can't.
What do I do now?
Don’t appeal. They always reject them. What’s in it for them to let anyone off?
What’s in it for them is information. They need to know the identity of the driver of the vehicle involved at the time, because that’s who the alleged contract was with. If they don’t know who the driver was, they have to make do with chasing the registered keeper.
With windscreen notices, an appeal letter will tell them your name and address, and maybe that you were driving at the time. If they don’t know who the driver was, they have to buy the details of registered keeper from the DVLA.
With postal notices, they’ve done this already. But they still need to know the identity of the driver.
They sometimes say that they have the right to ask for this information. This doesn’t mean that you have to tell them.
However, even if you’ve written and confirmed who the driver was, it doesn’t make their actions any less unlawful. It just means that instead of unlawfully harassing the registered keeper, they can now unlawfully harass the driver.
What will they do to me?
They will send you a series of letters, then a debt collector and then a solicitor. The debt collector and solicitor are usually also the PPC, but using different headed paper. These will threaten you with all sorts of financial and legal unpleasantness, to intimidate you into paying.
But, they can't actually do anything, for the same reason that a blackmailer couldn't sue their victim if they didn’t pay.
What should I do then?
Continue to ignore everything you get from the PPC and their aliases. Yes, it does seem counter-intuitive to deal with something by ignoring it. Eventually, they will run out of empty threats to intimidate you with, and stop throwing good money after bad.The acquisition of wealth is no longer the driving force in my life.0 -
Thank you, Stephen! All correct, maybe adding that (unfortunately) this is a subject the Police know little/nothing about and should not therefore be offering advice! Same goes for CAB who merely repeat what they get told by the scammers themselves...
You do not have to pay them one penny, even if they are lawfully able to issue an invoice, you are not in law required to pay it. And I say IF because this thread is about this firm trying to issue invoices on PUBLIC roads, = totally illegal!
Just ignore them from here on, you shouldn't have appealed, but no harm done, you probably mistook them for a reputable company....
After you have had the set quota of "scary" letters, they simply disappear. This company will not take anything to court as they know full well that they wouldn't have a leg to stand on.0
