I suspect he/she couldn't as TMO have a representative that posts on these boards so if iabw12 details their case TMO may use what is written to their own advantage.
That said, it would be good to find out if iabw12 had followed all the t&c etc etc..ummm...0 -
Many thanks BrendaY. I think it worth adding that every other letter I have sent since then (including court papers) has been sent standard first class and duly received within 48 hours.0

Hmm... shame, that's why you have to send via at least recorded delivery. Otherwise they'll just bin it and say they've never received your claim and that's it. Good luck with you case though. We're all behind you.0

guys - I've been away from the forum for a while, but it seems like not much has changed. However, as with, if I remember, BrendaY, it's second cashback time, got my 7th bill this week. Brenda, have you progressed your claim yet ?? I seem to remember we were submitting our first claims around the same time. I got my first cb, and reported it on this thread around 3 months ago, so I hope this was helpful for some people. I will endeavour to do likewise this time.......Gettin' There, Wherever There is......
I have a dodgy "i" key, so ignore spelling errors due to "i" issues, ...I blame Apple0 -
Mine is in the envelope ready to go but I am still waiting on this 7th bill hopefully it will come on Monday or Tuesday..0

If you asked The Mobile Outlet if the contract was for 12 months and they said 'Yes', why did you ask them the same question another 2 times within a week?
If you have proof that you bought a 12 month contract, then you would have some comeback, if you don't, I don't fancy your chances much.Well life is harsh, hug me don't reject me.0 -
Gunjack,
Ictmad,
Orange appears to be anally retentive about giving any clue on its invoices about how long a contract one is on - presumably in case one decides to act upon the information and terminate the thing when that becomes possible - so you need to look elsewhere for evidence of what you signed up for.
In my own case, I stored to disk - and printed out - every page of the online sign-up process for my deal, which clearly documented (among other things) that mine was a 12-month contract.
Didn’t you do this?
I then, at the outset, confirmed it in writing with Orange (to whom I have to pay the money) as well as with TMO (from whom I have to claim it back).
Didn’t you do this, either?
If you didn’t bother, I guess your only bet now would be to ask Orange what proof it has for its assertion that you signed up for an 18-month contract. If you didn’t, it has none and is therefore acting fraudulently in suggesting that you did - and in demanding from you money that you do not owe it
In order to claim money from you, Orange has to be able to provide evidence that you agreed to pay it. If what you write (in so far as it can be deciphered) is correct, how can Orange do that? Presumably, it can’t.
If Orange pursues you for money you don't owe, you can complain to Ofcom/Otelo, file charges against Orange for harrassment and claim compensation from Orange for whatever nuisance and/or distress it causes you. (I would!)
Tell Orange that, if it thinks it has an 18-month contract with you, to either show it to you or get lost. Then refer Orange to TMO and leave them to argue about it between themselves.0
