excel parking ticket advice please

    Hi, i am desperate need of some advice!

    In November 2011 i parked in an excel car park where the first 30 mins was free. I bought a ticket for 70p just in case i went over the free 30 mins and placed the ticket on the windscreen as requested.
    I returned after 35 mins to find a parking fine on my window and the ticket was on my seat, it must have fallen off whilst i had been gone!
    I contacted Excel who told me that i needed to appeal which i did explaining what had happened. They did not accept the appeal and said i had breached their terms and conditions by failing to display. I have since sent photocopies of my ticket and requested that they look at cctv to see me purchase the ticket but they have respond3ed by sending me a photo of my car in the car park!
    I have not paid as the fine is now at around £200 and has been passed on to their debt collecting team who are phoning me regularly and seem to be bullying me to pay and threatening court.
    I suffer quite bad with my mental health and have a disabled son and all this is making me really ill, please could you give me some advice.. should i pay up??

    Have you actually read any of the many postings on this forum?

    If you had, you would realise that Excel are a complete joke, they have no power to fine anyone, and appealing to them is a complete waste of time.

    Stop worrying, and just ignore everything they send you from now on. They will give up once they realise you're not falling for their con trick.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    In need of advice? Yet you are here on the MSE parking forum board where every thread tells you to ignore a fake PCN like this as it's a scam.

    What other advice can be needed? Have you only found this single thread by Googling I wonder, and thought that was it?

    You may have missed the whole parking board then, every thread is about this scam - and the current board showing all the threads is only one click away. Please see my signature below this post, just click ONCE to get to the whole board index, all the threads in view.

    Then click on the second to top one called 'PPC letters & threats'. Watch the Watchdog video linked on there and look at the letter-chain Excel use.

    Just play snap with each letter in future and don't be sucked in by the scam again.

    Next time they phone just say "the 'debt' is denied, please pass it back to the parking company and any other calls will be regarded as harassment and will be reported to the appropriate authorities".
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    Well, people find it on google search and they are upset so they post. Zap isn't the first and won't be the last.

    Zap, the worst result from their point of view is being totally ignored. That means, never contact them again, and if they call, do not speak to them. They think you are a soft target because you took them seriously enough to go through their fake appeal system, so just show them you are not, by taking no notice of them. When it dawns on them that they are wasting time and money on a fruitless attempt to con you they WILL go away.

    You paid for your parking, there is ZERO they can actually do. That is why they have to resort to bully-boy tactics.

    Hi all, just to keep you updated, i have now had the second "Roxburghe" letter total amount owing is now £142.00.
    The last paragraph on the letter reads..................................

    We are fully aware of anecdotal information being presented via the internet and on various websites and you may well feel this guidance is worth following. We strongly urge you to seek independent legal advice rather than rely on these options, and we would respectively suggest that you refer to the civil procedure rules part etc. etc..........................will keep you updated!!!!

    Yep, we know that letter!

    Try copying and pasting a selection of that sentence into Google and seeing how many times it's been mentioned on forums!

    I just love their phrase, "We are aware of anecdotal information being presented via the internet and on various websites and ... this guidance is worth following". Yes, it is. :)

    PS. They don't refer you to Part 31.1(2) of the Civil Procedure Rules, which says, “This Part applies to all claims except a claim on the small claims track”. Parking charge cases are heard on the small claims track of the County Courts.
    The acquisition of wealth is no longer the driving force in my life. :)
