  • I would just go straight back and say you want it put to arbitration TBH. Landlords are NOT allowed to claim "betterment" - and it sounds like everything yo have described can be claimed as "fair wear and tear"

    Did the Letting Agent give you a signed inventory on the way in and one on the way out?

    I only kept deposits - if a carpet needed to be entirely renewed - (three iron marks) or flat was completely trashed in which case I put a contract cleaner in to do the work (but lady did a moonlight and never came back for deposit anyway).

    Was your deposit registered - and were you given notification of who with (if not then you can claim 3 times the deposit back anyways)

    I've been looking and apparently you have to try to resolve it first. But I stated in my email if it wasn't resolved satisfactorily then I shall be taking it to the dispute service.

    i don't think they have a leg to stand on (bar the carpet cleaning, we did it but no letter to prove it) so i'm sure we will get most of it back, it's just something i don't need to worry about right now.

    I know there are lots of different jobs between all of us... does anyone have experience of letting agents?

    Ours are trying to take over £600 from us, because of a tiny rust mark in the sink and a scratch mark on the work top. They claim they both need replacing. Also, we cleaned the carpets as housemates mum had a carpet cleaner, but they are trying to charge us £140 for that and £40 for general cleaning.

    I've emailed back asking for evidence of damage and evidence that it warrants the full replacement of the items. I also explained if I'm not satisfied with the outcome I shall be taking it to the dispute service for tenants deposit.

    I'm tempted to go knock on the door if the new tenants are there and ask to see if they replaced them. What else can I do?

    Unfortunately the rust mark and the scratch would not be deemed as wear and tear and therefore you would be liable.

    If they have proof that a new sink and work top was purchased that is normally enough for the Tenancu Deposit Scheme to find in their favour.

    Usually the carpet cleaning has to be done by a professional so you can then give them a copy of the invoice - what did your tenancy agreement say?

    If you post on the tenancy board they will probably say the same - Nora had a similar problem but her bill was £1200 for less than you have listed and the people on the other board thought it was acceptable.

    I would still challenge it though just in case they are willing to budge on it. Do you have any pictures from when you left the house?

    When I tried to get the TDS involved with a dispute they said they would rather we sorted it out between us before they got involved - well hello that is what you are there for :rotfl:

    It would be a good idea to go back to the property to see what has been replaced.

    Thanks EE.... When my housemate finishes work, I might suggest we pop round and politely ask if we can take a look. If they haven't replaced it but the new tenants are in there, surely that will go some way in our favour? I won't even have a look then, I'm scared to! :)

    ETA: even if it isn't wear and tear, i honestly can't see them replacing the whole unit just for that. It seems completely ludicrous that they would bother.

    Got some news that I can't share yet as it involves work and I try to be ultra careful online but it has made me :) and may alter futures quite a bit depending on what I decide to do - sorry to be so cryptic but can't really say more, just ;):);) and a confused smiley too.

    Other:) that I can discuss openly is that dh and I have spent a week using cash and no cards and we have money left at the end of the week:T We are going to overpay things with the not spent stuff

    More :) as the cheque for the mini overpayment arrived today and I have a surprise £25 in the account form quidco - off to check why before I send it to the cc account.

    One of the interviews has materialised it will be on the phone to start with. However I have looked at the company website and what they do is against my bunny hugger ideology. Oooh - I am so torn. Should I tell the agent straight away and cancel the interview or raise the subject in face to face interview if I get it.

    how long did you live there? are you sure the marks weren't there when you moved in?

    For just over a year. Not 100% sure but the kitchen was totally refitted before we moved in so it's unlikely to be a previous mark.

    A rust mark on the sink would probably come off with a metal scourer... if the sink has rusted, then the sink was rubbish anyway...

    Marru - treat it as practice. Have the interview and make all your mistakes there rather than on the ones that matter :)
