can i claim the admin fee from catalogues

After reading all the posts about reclaiming catalogue charges I decided to bite the bullet and send my first letter to Empire Stores to reclaim charges for around £180. I emailed the edited bank charges letter to them three days ago and today got a reply saying that it is made clear in 'your account' section that charges are applied if you fail to make payment on time, then a big lecture about not making payments ontime and that the company is NOT PREPARED to remove any charges from teh account. They then say I can confirm that this letter concludes our investigations into the complaint, I hope this meets your satisfaction if not you need to refer teh matter to the FOS. POlease note that this service requires you to make a complain within 6 months. They have also enclosed a list of all charges. What do I do now? Should I send them the second letter and do it by recorded deliverey? has any one had charges refunded from Empire lately? Thanks

    Write back to them thanking them for their kind advice and tell them that to save court costs to themselves and further administration costs you would like them to pay you in full or you will take the advice of the Office of Fair Trading in their report on Default Charges. which is(insert the bit in bold).
    OFT 842 on default charges April 2006(I just love the report btw) states in paragraph 1.14, page 4)

    "1.14 It must be stressed that this is a statement of our position and reflects the exercise of our discretion as an enforcement agency. Only a court can decide finally whether a term is unfair, or at what level default charges should be set to meet the requirements of the UTCCRs. It should be kept in mind that other enforcers may apply for injunctions under the UTCCRs and that the UTCCRs may be relied upon by consumers in private claims"

    After sending my first letter on the 3rd April I have since had 1 letter which said they would pay back £83 something, I wrote back with the 2nd letter about taking court action and have since had a reply stating that I would receive the £160 of charges back + about £16 of interest and that someone would contact me regarding the payment protection; however 2 days ago I checked my account and they have refunded the full amount I initially requested :D, leaving about £11 left to pay on my account which I shall be paying next week, so great result, account is in good balance and will be getting the balance reduced to £100 as it comes in handy when they have things on good offer at christmas for presents; although, I did noticed they have reduced my spending limit already from £600 to £250, but not an issue to me because I was going to reduce it anyway.

    So there will be 1 less bill for me to pay each month which means I can put that money I would normally payout towards another bill instead, providing that my other bills don't go up.

    I have also managed to help my mum get her catalogues sorted, letters are in the post so just got to wait for the replies.

    I'm about to ask for charges list for The Next Directory, has anyone claimed from them?
    Just got £100 back from Halifax thanks to this site!! .... over charging on Mortgage Exit Fees!!!

    i am trying to from Next but got a letter back saying they dont charge fees (Bull!!) and that they are not a credit or store card and that the OFT has not said their fees are in dispute, is this true?? xx

    I have claimed for money on behalf of my sister ( i have already claimed and was successful)
    The studio have sent £250 vouchers for the catalogue.

    Is she entitled to money instead?

    How would i write it in a letter?

    Any help would be greatful.

    You need to verify if this is for the charges that they have taken or not. If it is and the catalogue account is closed, I would send them back and state you require a cheque made payable to .......

    When you click on this forum all the titles of threads appear. on the top right is a tool which says "search this forum". If you do a search it should come up for you.
    If you have a specific question on reclaiming then just shout and I am sure we can all advise you
