My £10 cheque has been cashed so shouldn't be long now till I get statements. How's everyone else getting on? Anyone had any luck with them yet?

Can we claim for charges from mail order cataloges ( studio cards my main one ).
I am asking on behalf of my sister who is charged for been late £20 then £11 intrest.
She is allways on time but sometimes because of the post she ends up being late and gets charged, so because I am starting the ball rolling with my bank and the charges war. I was wondering if she could do the same with Studio cards, seen as you can do it with store cards etc etc.
  • I want to send a letter asking for the charges back which were made with studio cataloge but unsure on what letter to send as i cannot send the bank one.

Any one help me on this please.
  • I've been one of the successful ones in claiming back my bank charges. I'm going through the process with my credit card comapny at the moment. Just wondered if I can claim back charges from my catalogue account? It'd be for things like late payment fees. Any ideas?

I'm just greedy but hey if I can than why not!!

Sent letter to Daxon requesting refund.

The interest charge is added using the previous balance at the top of each
    statement, less any returned items.
Where interest is charged, the value will not be less than 50 pence per
    statement.
If you pay the full balance, to reach us by the due date shown on the statement no interest is charged.
We are writing in response to your recent enquiry regarding the administration
    charge on your account.
Details of the charges are printed in the company policy in the back of our
    current catalogue.
Whilst we appreciate your comments, we are sorry but on this occasion, our
    charges will stand.

    Sent them the following,

I refer to default charges applied to my account, £38.92, which I have requested you pay back.

I wrote to you on 19th January 2007, making the original request for a payment in settlement of my claim. As I have not received a satisfactory response, I am writing to inform you I intend to claim the full amount together with court fees in the proceedings through the county court.

This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the court will rule in my favour.

I look forward for a full response to this letter within seven days, otherwise I will commence court proceedings to reclaim my money.

We are sorry you are not happy with our Company policy regarding interest and Administration charges but our decision stands .As previously advised terms and condiitons are shown clearly in the back of your catalogue. If you still refuse to make this payment please be aware that this account will be passed to a Debt Collection Agency. They are authorised to take any action necessary to recover the outstanding balance.

So what do I do now. We are talking less than £40 although probably added more charges now.
Should I pay up and then claim it back?
Is it worth starting court proceedings over such a small amount?

    Help please!!

Is that £38.92 all penalty charges and if so, how does it break down - i.e. how many charges made that total? You will be liable for interest on items you haven't paid for if that is what their t&cs say so can't claim that back.
