Any advice is appreciated - i am seriously annoyed at their ridiculous offer!!!!

This is not an uncommon reply, see Martin's Credit Card reclaim article for the options and what this may mean for you.

It's a personal decision whether you want to continue. If any refund does give you a positive balance on your card, you can normally close the account and ask for a cheque.

Thanks for the above, but this guide is mainly about current accounts and credit cards, not catalogue accounts.
  • I recently tried to claim back £270 from Studio Cards.

I had a £100 balance which they agreed to clear and then instead of giving me the remaining £170 in a cheque they sent me gift vouchers

I rang them up and they said that they couldnt give me money and that if i had a problem with it i should write to them and send the vouchers back but there were no guarantees.

I dont want to send the vouchers back and then get nothing, but can they really give you vouchers instead of money? After all i paid the charges in cash not gift vouchers!

I'd wait for an expert to come along, but I think it can depend on what they were reimbursing you for. If it was something under a breach of Trade Descriptions (i.e. the goods were not as described, of poor quality or otherwise not fit for purpose), then you are entitled to a refund of your money. If you returned something for a different reason, or you don't have a proof of purchase, you may find they reserve the right to give gift vouchers instead. Can you give more info on the circumstances? :)

Hope that helps, but as I said I'd wait for some more in depth advice. :)

  • basically it was where i had been charged for paying the account late.

When you say gift vouchers are they for studio or are they those high street type vouchers? Might come in for xmas if they are.

Do you have the arrangement in writing regarding the settlement, have a look what they say in the letter. I would also check the letter for a direct line number as any general customer service line probably won't be able to help you and will try to fob you off.

You could return the vouchers with a letter stating you only agreed to settle providing the balance was paid in cash and unless you recieve the cash within 7 days(or 14 depending how long you want to give them), you will proceed with your court action/complaint to the FOS (whatever you had said in you previous letters).

I would send the letter recorded or special delivery so they can't say it didn't get there,

  • With mine they cleared the account and sent me a chq, this was about 3 weeks ago
    Studio, MBNA - Paid out
Bank of Scotland, Argos- Offers received Court Letters Sent
Fashion World, Value Cat - 2nd Letter Sent
PPI - HFC - Letter sent
HFC PPI, Capital One - With FOS
  • Studio cleared my account and sent vouchers. I have kept the vouchers to use as christmas money. If you do decide to use them make sure you send them (recorded delivery of course!) at the time you send your order in as they wrote back to me after an online order to say they needed payment up front. Sent vouchers then received goods.ML

Now why didn't I take any notice of the
    second part of that quote!!???

I am thinking that I should accept their offer, ask for cheque payment and ask them to close my account down.

    Would you suggest this?

I would pursue this to the FOS. The worst that would happen is you end up with nothing (£7 loss isn't exactly a great loss). Most likely you will end up with the whole amount of charges refunded. Make sure you put in your complaint that you want the refund as a cheque not via your account.
    good luck
