I would definitely try and contact Studio on her behalf. I have sent late payments to them before and I have never got charged that much - think about £12.00. I sent them a email recently saying I hadn't received my most recent statment (only £40.00 outstanding) and they put the account on hold with no charges until they sent out a duplicate.

she ordered the xmas lights,,the lights arrived ...then she had a certain amount of time to either pay in full or may the minimum payment..she paid the amount in full using postal orders but the payment didnt clear until 3 days after their "pay by date" .. hope that makes sense lol .. i have wrote a "debt in dispute" letter to the debt collection agency ... do you think it looks ok?

Therefore, I consider this account to be in dispute and no further action or payment shall be made until this matter is resolved.

I would add a paragraph stating:
You will be aware of the recent publicity regarding penalty charges being unenforceable under English law. Clearly, the charges which you purport to apply are not a genuine pre-estimate of the loss likely to be suffered by a breach (paying 3 days late). Accordingly, they are unreasonable and unlawful. Further, or in the alternative, any terms and conditions which you purport to rely on in relation to the imposition of such charges would be subject to the Unfair Terms in Consumer Contracts Regulations. I have absolutely no doubt that they would be deemed unenforceable.
Regarding the Data Protection point - give them a signed authority from your friend authorising you to deal with the matter on her behalf.

Yay! Just wanted to let everyone know that after reading all these threads i decided to try and claim some charges back from some of my catalogues....(i had lots....bit foolish a few years back!).
Good News
Studio refunded all my admin charges totalling £285! They have taken it off the balance outstanding so my debt with them is now £65 :j
Capital One have refunded our charges totalling nearly £1000, clearing the outstanding balance and leaving us with roughly £350 in our pocket to pay other debts off :j
Bad News
Simply Be / Viva La Diva / Crazy Clearance all sent letters back telling me that they deem the charges to be fair......they seem to think £12 is in line with OFT guidelines. The funny thing is, they have charged me £12.......twice on one day everytime they have put charges on my account! So, in reality they have actually charged me £24! Crafty huh?! :mad:

Citi Financial have declined my request of a refund on my husbands PPI claim on a personal loan. Although in the army he was still sold PPI even after telling the muppet that it would be very unlikely my husband would lose his job.......in the current circumstances of the war in Afgan he is more likely to lose his life than his job! :mad:
All we need now is our bank charges back and we could be debt free......the thought fills me with excitement.....bit like an overgrown child in the Cadburys Factory! :rotfl: :j0 -
Hi jenlacy! Where did you send your studio cards request to? I sent one in with my last months payment with the £10 chq and they just took it of the balance along with the payment!! No mention of the SAR request at all !'Neither a lender nor a borrower be'
Now why didn't I take any notice of the

So after reading this thread from start to finish a couple of times I have taken the plunge and emailed Studio Cards for a list of Administration Charges (their name for late payment fees!!).
I've had a look at my online account and the last thing I bought from them was in 2005, yet I still owe them over £500 :eek: . I think they've charged me £20 pretty much every month this year alone. I still haven't received my statment for this month and that's due to be paid soon so that'll be another £20 if I'm late paying because I haven't received the statment again!
I just hope they won't close the account and ask for the full amount back because I'm making a claim :rolleyes:0
