    My account with Studio defaulted and went to debt collectors. I was charged a total of 80 pounds in administation charges the goods I purchased totalled 21.47. I have a remaining balance of 50 pounds

    I have spoke to customer services today who basically told me that they would not be removing the charges as i had entered a contract when I purchased the goods and have defaulted on my account, does anyone know if this is this right? He was really rude and would not listen and implied that I have not paid any of my balance when in fact I have paid more than half of the original cost.


    I have sent a letter to studio requesting that charges be removed from my account but the debt collectors are demanding i pay the remaining balance should i pay this or wait till i recieve a reply?

    Any advice would be really appreciated

    Keep going.. they always say no and it's t&c's... most organisations are paying out to people who are determined and keep on at them... if everyone gave up after the first hurdle... the organisation would win and it would save them a lot of money!

    If you do want to pay the remaining balance you can if you want to... you can still claim from closed and paid off accounts.. they will just send a cheque.

    I've not had any experience with the company you are trying to reclaim from but I would say move on to the 2nd letter template (found on this site) - could also send emails at the same time (worked for me - after sending the 3rd letter/letter before action - I sent the email daily for a week and then got a cheque; didn't get any responses to the emails though... but got a cheque so not fussed :p )

    i have a catlog debt with littlewoods, my fault i was late with a few payments so they trasferred the debt to nationwide debt recovery, agreed a £45 monthly payment programme which i stuck to.

    a couple of times due to kids work etc was a couple of days late paying rang them up "no problem we will reset that for you"

    anyway last month my son had to have an operation, i tried ringing them (0870 number) on hold for ages worried about phone bill so wrote to them explaining i would be paying but a bit late, which i did by cheque

    anyway get a letter from littlewoods telling me to contact them letter dated 14/08/07 got it on 3rd sept!!

    got a letter from nationwide debt recovery today telling me i was an "evasive debtor" and adding a £20 charge which they would waive if i rang them with payment and my phone number

    i rang littlewoods who said it was "outrageous" i had had so many resets on my arrangements and they said they thought i should have to go to court and general abuse, then put me through to nationwide debt recovery who demanded the whole amount i said no, then said we will accept £78 a month, i said no i cant afford that offering the previous £45 a month i had been paying, she said yes if you pay 2 months this month i said no, she said i can only allow you to pay £45 for 2 months then we will review your account, i asked what that would mean, she said that it will probably be passed on to someone else

    is that a good thing or bad??? i think the £20 charge is outrageous also calling me an evasive debtor i have always paid them and am insulted

    any ideas???

    I've got an account with La Redoute but I have never got any charges from them so I havn't asked for any back...

    well I had Total Cover on my account which I took out because they said it covered damaged clothes ie: rip or stain on the item and you can get a replacement - (too good to be true really!)

    anyway 6 months on I've found that 5 shirts/tunic tops I got from them have faded incredibly quickly.. within 2 months of wearing them a couple of times (low temp wash and colour detergent used) so I asked if I the total cover 'covered' this and they said no.

    I've just got a letter and they said as a gesture of goodwill they will refund the money of the premium back with 8% interest!?!?!??!? I didn't complain or ask for it back... only to have it cancelled.

    I think they are rather paranoid and must have had a lot of people asking for their charges back - but if they looked at my account they would have seen I can't do that as I don't have any!
    bizarre.. well my balance has dropped £110 - woohoooooo :beer:

    (I've also just won a year's supply of 'simple' products and in the last week I got 3 cheques for refund of charges --- I'm rather known for my bad luck so I'm rather shellshocked! lol :D (the sky will be falling down next week then :rolleyes:)

    They are trying to scare you (it usually works as people panic and then pay up the extra charges)
    I love the way that companies always say that if you are in financial trouble then call them but then they ignore you or tell you 'hard !!!!'?!??!?!?!

    follow the main part on this site and ask for ALL of your charges back. And they will say no - most companies are only refunding people who are prepared to go all the way (cheaper for them that way as most people don't know the law (me included - scares the wossits out of me! :eek:)

    I've posted my success on this thread with another catalogue - I didn't think they would refund the money without court but they did...

    It's worth a try.. and they have not been helpful to you - even if you went to court (not about all the charges back but not agreeing to pay £45+ a month because you can't afford), a court would let you pay £5 per month as you are paying something.. it's only if you refuse to pay that can cause problems.. and they should be offering to set up a payment plan that doesn't incur any charges (as that's the whole point of debt collection!!)

    keep going and don't let them scare you (my recent wins are making me bold :o) but you did try with them and they are being unfair.. time you got a little unfair too :D

    Anyone know if NEXT charge for statements? I need copies of all of them, I've thrown the old ones away so I've only got recent ones. From memory, they owe me about £200 in charges.
  • Just to let you all know, I have just received the money I was owed off JD Williams. They are awful to deal with but after I got the money back off Simply Be and Ambrose Wilson, they paid out fairly easy in the end (its the same person who deals with all companies).

    All my accounts are now clear with these catalogues and I am a very happy person. :j

    My message to anyone trying to reclaim off these people is to keep record of everything and use it against them if you have to. You will win in the end.

    In total I have reclaimed over £500 off them. :T

    Congratulations willenhall. I not only got most of my accounts with Simply Be and Naturally Close paid off with offers, I lalso wrote to them about an amount outstanding that I could not remember what it was for. I sent a letter I got of CAG site saying in all legal jargon that I had no knowledge at this stage and wanted copies of all original paperwork with signed agreement etc. They wrote back saying they would not be writing to me again in connection with that account. Most of you will probably agree - especially if you open these accounts online or the phone - in most cases there probably is no signed agreement and therefore apparently unenforceable.
