can i claim the admin fee from catalogues

Hi, An update.
I have now been paid back the full amount I have asked for from Simply Be and Ambrose Wilson. My one account was cleared (which was about what I was claiming, so I was happy with that), and the other account was cleared also, but because it was £130 less than what I was claiming, I told them I was not happy with that. I said that I would accept them clearing that account and told them that I will still persue the rest of the claim in court. I had a letter back saying that it was not financially viable for them to defend in court so they would offer me the £130 back as full and final settlement.
I made a complaint to the Data Protection Commissioner about not yet receiving my data for JD Williams (so far it has been 80 days) and also I queried with them if I should have paid 3 x £10 cheques for the data I requested in view of all 3 catalogues being of the same company. I also mentioned that I have actually been asked for another £10 cheque before they would let me have any data for JD Williams. (The Data Protection Officer said that they did not receive the last cheque.) Luckily, I could prove they did receive and cash the cheque on 6th June. Upon being told that I have made a complaint, they squirmed a bit and then admitted they had got the cheque after all, and immediately refunded my 3 x £10 payments.
I am still waiting for the data from JD William, and this week I sent a stinking letter telling them that my complaint still stands with the Commissioner until I get my data. We will see what happens now.
They are a terrible company to deal with and will try to get out of everything in any way they can. My advice to anyone claiming off them is to make sure you keep copies of everything and send everything recorded delivery. They will pay up in the end though.
So far I have got around £400 refunded from both Simply Be and Ambrose Wilson, and £30 refunded cheques, giving me my data for free (so I am well pleased so far).0 -

I've not any response from Simply Be except to say no - two letters the same day - one from Ambrose Wilson and the other Simply Be - I've got two account numbers despite only ever buying from one!
How many times did you have to write? maybe I'm not writing my letter very well
I'm sending the letter via email now - daily... still no response except the 'we will response in 5 days' the first of these was 3 weeks ago!
I'm hoping I don't have to start court proceedings but I will have to if they don't respond soon.
Has anyone had to start the court bit with Simply Be????
Can I ask how long it took Willenhall - too get your refund?

Hi, had a letter off Grattan yesterday, it says they've recieved my request for a refund, but they are going to wait to see what the outcome of the well publicised big court case regarding the banks etc, is before they give any refunds. But it said they will keep my request until the verdict.Has anyone else received this letter from Grattan??Helen

Wiggynut, I believe that you wont have to go to court but you will have to threaten them with it. I sent the letter threatening court and gave them a week to reply. The week went by, in fact a couple of weeks went by and then I got a letter making the offer of settling the accounts. The one account was for much less than what I was claiming off them, so I sent a letter back accepting the offer of clearing my account and told them that I will then be persuing the rest in court. I had a letter straight back then saying that it was not economically viable for them to go to court for such a small amount (£130.00) and that they will send me a cheque immediately to clear it if I agree but I had a load of waffle about how they were not at fault etc etc. Naturally I accepted the offer.
If you paid them £10 x 2 for your data requests, take a tip from me, I challenged them on that and told them that as they are all of one company, I believe I should have only paid the one £10. I told them I was going to make a complaint to the data commissioner (which I actually did) and they immediately sent me a letter offering me all of the money (in my case £10x3) back and said that they would supply the data for free. They seem to be afraid of being reported to the data commissioner, so if you think they have taken too much off you to supply the data, try telling them you are going to report them. :-)
Make sure you keep all evidence of everything though, they are so slippery.0 -

They are stalling you. What is happening with the banks have absolutely nothing to do with catalogues or credit cards etc. Take my advice and continue with the normal timescales and ignore what they say in their letter.

they said that after extensive checks they did not receive a request for a list of charges from me - hmmm... so why did they cash the cheque then! Anyway... only a tenner so I'll let them off
I'm on a winning streak - got a letter yesterday from a (nightmare) credit card who have decided not to go to court - court date was for next Thursday and I was getting rather scared (never been to court before! :eek:).
Soooooo pleased - hope everyone else gets the same response and thank you to everyone who helped and kept me going.. I was starting to get fed up and thinking it was a losing battle!

yay!! I was starting to doubt it myself - I'm so pleased I don't have to go to court as well (for a credit card)... so to get two 'wins' is brilliant!
The letter from Simply be was dated the 28th and I've since sent them about 6 emails in the time it took to reach me! lol
thanks for your help - did keep me going. I usually let stuff happen to me and not fight back so I'm feeling rather pleased with myself.:D
