    Service charge is the interest you owe them for getting goods "on credit"

    thanks lee - so, no joy - woe - i thought id have some cash coming - i have never been late paying so no charges...apart from this week with my bank - the first time ever i have gone over the agreed overdraft but, after speaking to the bank they have agreed to waive it.....

    Not stalling but certainly taking the proverbial on the demand for another tenner. You will have to send some ID its a security precaution but the inital £10 is the statutory fee payable for a SAR (Subject Access Request) under the Data Protection Act 1988, providing this is what you asked for when requesting details and not copy statements. They can charge per statement for them.

    But if this firm has tried to ask for money previously it is another stalling tactic.
    If it's okay for them to ask you for money without doing an ID check then they can provide the SAR without it.
  • I am currently claiming from Fashion World, which I think is the same company as Simply Be. After getting my statements through its taken three letters before I got a reply, and what a reply!!! Two page letter telling me about the OFT ruling and why they don't have to abide by it, why it's all my fault in the first place and that they would pass me on to a collection agency because its obvious I have financial difficulties!!! I have just written a nasty letter back but will wait 'til I calm down before reading it again and sending it.
    Any ideas what to do in this situation, they claim the court will rule in their favour and I think they might take it to court and defend.

    Can anyone help? I have a number of catalogue accounts that have been passed over to debt collecters. I know that I have been charged late fees on all of them, how would I go about claiming this back?. Do I send SAR to the catalogues or to the debt collecters?

    Send them the letter asking for repayment of your charges. If you look on this forum you will see that they are just trying to intimidate you into not claiming.
    They do have to abide to it and they have no right to pass you on to a collection agency if your payments etc are made on time, again it's just a bullying tactic.
  • Thanks 'joe1965', I am going ahead with sending my letter to them today, although am still a bit nervous!! I have quoted the unfair terms in consumer contracts regulations terms so I hope they realise I mean business! Will keep you posted.

    Hi,
    Ive got my reply from Studio,there saying that in light of the OFT investigation,as a goodwill gesture they have reduced all admin charges on my account that exceeded £12 and paid my account off with it!!! :mad:

    I didn't want that!

    Can I carry on now with the next step or have they ended it now as they have cleared my account? How do I get round this? I want the rest of it back in a cheque! They also used my £10 cheque for statements as a payment into my account,so it kind of feels like Ive not gained anything here!
