can i claim the admin fee from catalogues

    I sent my letter to:

    Customer Services Dept.,
    Ace,
    Preston,
    PR0 2RP

    Took them about 10 days to get the statements to me, good luck xx
    So far:-

    HSBC £2515 incl int claimes, settled on £1998:j

    Abbey - £2995 claimed, offered £1098, accepted as part payment and proceed to next stage, response not satisfactory so currently with Ombudsman:confused:

    Cap 1 - settled on charge difference:j

    Barclaycard - settled on charge difference:j

    MBNA - 1 account settled in full, £993:beer:
    - 2nd account settled on difference:T

    HSBC Visa - no charges amazingly!!:rotfl:

    Household Bank Visa - settled on charge difference:T

    ACE catalogue - settled in full after 1 letter!!!:beer:

    i was wondering if anyone has any advice on my problem with a catalogue i made two late payments and have incurred admin charges this was dec and jan i have four lots of 10 pound slapped on for not paying these charges, i have payed for all the goods in feb but they still keep putting admin charges on is this right
  • I am trying to get £100 back from Choice For You who are under the Littlewoods Shop Direct umbrella. They didnt reply to my first letter within 14 days so I sent LBA they have replied just saying they will contact me again once my complaint has been investigated but have not given me a timescale.

    Shall I just proceed now with MCOL? Has anyone else been successful in getting money back from these?

    I wrote to them a few weeks ago asking for a list of charges etc as per the template - I actually amended specifically asking for certain statements that I don't have! It was sent Recorded Delivery and as of Tuesday, they still hadn't signed for it.

    Today I received a letter from them (dated 5 April) which is set out below:

    Thank you for your letter concerning charges to your Next Directory account.

    I can confirm that the Next Directory only introduced default charges, set ast £5.00, on April 18th 2006 therefore, no default chages have been applied to your account.

    The recent media coverage and OFT announcement that you refer to relates to Credit Card default charges set at higher than £12.00. Credit Card default charges are charges in standard credit card contracts for a failure to pay a minimum payment on the due date, exceeding a credit limit or a failure to honour a payment made. The OFT have also indicated that a maximum charge may apply to charges in other consumer contracts such as bank overdrafts, store cards and mortgages.

    Your Next Directory account in neither a credit card nor a store card but a mail order account. As such, the OFT have not set a maximum default charge level. The £5.00 charge represents actual or liquidated losses and as such Next Directory are entitled to make this charge where the agreement is defaulted upon.

    I trust the above is to your satisfaction and if you require any further assistance, I am available Monday-Friday between 9.00am and 3.30pm on 0845 6100504.

    I know this is a fob off letter and they haven't sent anything that I asked for, shall I now send them a letter saying that they haven't done as I asked (ie send my statements) - I got most of them by calling the Arrears Department and telling them they had to provide copies under the DPA but I'm still missing some statements 1-8 although I don't think there will be any charges on them as they are the first few months!!

    I'm gonna go through them all now and see what I can find and start on letter number 2!

    OMG! Can't believe it, I can only find one charge!!! Pity I can't claim back the service charges - I'm sure they're diproportionate!!!! Oh well, not sure it's worth my while claiming it back although I can't really see where it came from!

    I'm sorry, did you not have goods off them which you then decided not to pay for? Why should you get money back for that?

    For your information, I lost my job in October 206 and they refused to accept my reduced payment offer on more than one occasion, when they did see fit to set up payment plans, they cancelled them without my knowledge for no reason.

    I'm trying my best to get myself out of the situation I'm in but I don't appreciate being fleeced by companies for circumstances beyond my control.

    I now have a job but I lose nearly £200 each month due to ill health and cannot afford these charges (I'm still on probation and do not qualify for SSP).

    So if my actions are offensive to you, tough luck.

    I've noticed from my trading statement that they charged me a £0.30 card handling fee - considering I've made payments before this and after this, I'm not sure why they've suddenly charged it. Could I claim that back too??
