Hi Keza, just bumped this back up as was wondering what occurred when you took this to court ? Any update at all.

Hi, Yes you can, do it the same as you would for a credit card, send off £10 asking for your statements, when you get those, write a letter, (should be one that you can copy on here somewhere) asking for your late charges etc back, they will I expect so no, but just carry on, go to the FOS or court...good luck...Lilly0

Update. Filed claim on MCOL. Today received response from the Court saying the Shop Direct intend on defending the claim.

I have a dispute with Shop Direct (that's the Littlewoods catalogue group isn't it?)
I bought two items back in May 2008 and when they came through I sent my details of to set up the direct debit, they never did this and in December 2008 I got it all refunded and just had the amount at the beginning to pay so I called this time giving my details...surprise surprise nothing was set up when I rewrote they have now refused to pay back the charges and moved it on to debt recovery!!
Would love some advice on what to do??
Seems ridiculous that I have to pay for their incompetance!!0 -

From what you state, seems like you have a good case for a compliant. Quite frankly I am not surpirised that they have failed to set this up. The left hand department doesnt seem to know what the right is doing?
Definately keep the presure on and send another final letter advising they reimburse or court action will follow, then continue onwards to the court.

Not sure if this thread is still active ....so not sure if anyone will reply but here goes...
Having read all the posts on here about studio i checked my statements. My account was eventually passed to a debt agency at £450. I have been paying this balance off by standing order at £50 per month. I was just wondering as looking at my old statements I have been charged at least £200 in admin charges and default charges. Is a default sum different or can i still claim for them? Having hid from my debt nightmare for ages and finally having my LBM I am attempting to address my debts. It would be really nice to get to a point where i can answer my landline, and if i can reclaim the £200 it would be a step to reducing my debt mountain. I have found this site to be an absolute godsend and thank you all in advance for any advice offered.

I would like some advice please, hopefully from someone who has tried to reclaim the charges that a catalogue has imposed on them:
I sent Littlewoods the template letter asking for repayment of charges, along with the schedule of charges applied to my account and this is the response I got:
'My understanding of your complaint is that you are unhappy with the administration charges applied to your account and have requested to have the charges reimbursed to you.
Having conducted a full review of your account I can confirm the following.
It is made clear in the credit information in the back of the catalogue and the terms and conditions of your credit agreement that a charge is applied should you fail to make your minimum payment on time and as such I am satisfied that the charged applied to your account are fair and reasonable.
Please be aware payments are required every 28 days as detailed in the ‘your account’ section at the back of the catalogue. If your minimum payments are not received as requested on the due date of each statement, administration charges may be added to your account.
We are aware of the statement of the Office of Fair Trading’s position regarding fair charges. For reasons given above we are satisfied that the other charges applied to your account are justifiable in accordance with the views of the OFT and are fair within the Unfair Terms in consumer contracts regulations.'
I am not sure what to do next, I do not want to just give up on it as it is a fair few pounds involved, but their letter reads as being quite final.

Yes remind them that the OFT also stated that only a court can decide whether the charges are fair. Tell them that their choice is either pay out in full or have unnecessary further costs of having to defend a county court claim in which you will seek a full breakdown of their costs to administer your account.0
