can i claim the admin fee from catalogues

    Yes send them a full SAR - ask for everything they hold on you not just charges.

    Hi guys / NWSM you there?

    I've had a reply from Shop Direct Finance to my initial letter where I pointed out the charges on my account with Kays. Received a response today and here it is - it's a bit long winded.

    "Further to our letter of 3 Aug concerning your complaint regarding admin charges applied to your Kay's account an dyour request for a full refund.

    Please find enclosed Appendix A, a full and detailed list of all admin fees applied to your account and the reasons for these charges.

    Your statement that you have been unfairly deprived of money due to admin charges applied to your account is refuted. Administration fees are applied when payments are not correctly received on a customers account. The full explanation as to the charging of administration fees is detailed in the back of our catalogues which are seasonally issued. You can also find this information by checking your account on line.

    It is our belief that the admin charges applied to your account are correct and fall within the guidelines set out the Office of Fair Trading, therefore no refund of administration will be applied to ytour account.

    On 23rd December 2008 yu received as a gesture of goodwill a refund onf one admin charge, this credit of £12 showed on statement number
    34 issued 3 Jan 2008.

    I appreciate that this may not be the response that you were hoping for and any upset that may be caused is regretted. I can confirm you have a balance outstanding of ..... and a minimum payment due by 5th September of £39.16. As long as all payments are received as detailed in your statments produced every 28 days no further admin charges will be applied.

    Thank you for bringing this matter to our attention and giving us the opportunity to respond.

    As your complaint is in relation to an event before 6th April 2007, unfortunately you are unable to refer your complaint to the Financial Ombudsman Servie (FOS) as we were not a member of a Dispute Resolution Servide until this date. I feel it is appropriate to point out that, if you do decide to refer to FOS, it is unlikely that they will consider your compaint. However, they will require you to confirm that we have issued a final response and to that end you may consider this letter as our final response.

    Sorry to 'harp' on - I didnt know if it was necessary that you see it all. I'm a bit baffled. The last paragraph about 6th April etc. I thought that these charges were seen as unfair. The reasons they have given are the reasons that I put in my letter, None receipt of payment, late payment, letter issued regarding arrears. It's over £300 - cant remember now without looking back thro thread and my letter sent.

    Is that the end? Have they got themselves covered? Sorry if I'm asking silly questions, yet again!!

    If that is their final response then so be it. Just to clarify, they came into the remit of the Financial Ombudsman Service in April 2007 as part of the changes to the Consumer Credit Act 2006.
    I would say that you have given them the chance to prove it. If that is their final response then I think you are taking them to court over the charges.

    Hi all, I cant find a definate answer to this anywhere so here goes...............can anyone give me a definate answer as to whether or not I can claim back 'service charges' from next? I know you can claim admin fees and late payment fees etc but can you claim back service charges which seems to be the interest if you do not pay off the balance in full each month, almost seems like a fee for not paying up lol

    Apologies, I thought that was the second letter. In that case yes send a second letter and add something to say, that to save additional litigation costs on their part you will settle for £x.xx(the full amount of the claim). Should they fail to do so you will show this to a judge and ask for additional wasted costs.

    No unfortunately not. They are variable amounts, right?
    That means that it is interest on any outstanding amount remaining.

    Yes they are variable, sometimes £7 and sometimes as much as £40. The good thing is I have just cleared the balance and am trying to close the account (which isn't simple) I have already read the other posts on here which say the same, anyway I just wondered if it was possible. Thank you for informing me, many thanks

  • Hi All,

    I stupidly have 5 catalogue accounts with Littlewoods shopping group (i.e. Choice, Additions, Littlewoods, Littlewoods Direct and Marshall Ward). I have had late payments on all of them over the years and am currently on a DMP with them.

    The total charges for all of them are : £448.80 inclusive of the 8% interest.

    I wrote to each using the templates and have received 2 replys, 1st one saying no, these charges are acceptable, so I sent the 2nd template letter saying that I was only reclaiming 1 years worth of charges and if they could refund to my one account that would pay it off and that I would not claim any further. I've had the 2nd letter back saying, our answer is still the same we're not going to credit you anything!

    What do you reckon, shall I pursue through the small claims court, is that what I would do?

    Any advice welcomed.... many thanks
    (have had one sucess, have managed to claim back HSBC CC charges in full today... am delighted)

    I did the same thing last year and they took all the charges off my account and now that I have fallen behind again they are refusing to take them off again.
    So I'd love some advice about Littlewoods as well.
