sent that one yesterday and got the reply
Dear Customer
Thank you for your email.
On viewing your account, we note that we receive payment on 07/05/09, which
shows on statement 146, printed 04/06/09. This had a minimum payment
request of £5.00 which was due with us by 27/06/09.
As this payment was not received, the £12.00 charge has been added and will
stand.
Kind Regards

perhaps I should cut my losses and close the account in protest.

As none of the letters suggested SEEMED to work I wrote and asked them for my terms and conditions as all else had failed. Told them I was sending all emails sent and received to FOS along with my terms and conditions. Went in to close my account today and pay off my balance in protest and Guess what they had taken off my £12.00 penalty fee. So a big thankyou to you for all your help. Keep up the good work

Thanks for your email about the previous charges on your account.
Unfortunately we do not have access to that information and we are unable to direct you to that information on our website.
The only way we can supply that information is for you to advise us how many of your previous statements you wish to receive to check and we will be happy to send them to you.
Please be advised their is a £5.00 charges on your account per statement you need.
This is the only way we are able to provide the information you require.
If you have any further questions, just let me know - I'll be happy to help you.Current Mortgage balance - £363,785.35/£420,000 (highest point Oct 2022).0 -
You need to request the information under the Data Protection Act thus http://www.moneysavingexpert.com/redir/5dfbe25a will cost £10 for everything they hold on youLegalBeagles0

Send a subject access request notification to them. It will cost £10 but you will receive every piece of information they have on you including all the statements.
...And take your name out of the postWow, I got 3 *, when did that happen :j:T:p
It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted
I live in my head - I find it's safer there:p

One last letter and tell them that they have 14 days or you will a claim in court and they can tell a judge exactly how much it costs for default charges.
You have to follow through and take them to court.0 -
NWSM - you said keep you updated. Today I've had a letter from Shop Direct (Kays) to say as follows: -
"Thank you for your letter of .... concerning charges applied on your Kays account. Pls accept our apologies for any inconvenience this matter may have caused you.
In the intereset of improving the service we offer to our customers, all complaints received are taken very seriously and we will contact you one a full investigation of your concerns has been made.
If, after we have investigated your complaint, you are still unhappy and you feel the matter has not been resolved to your satisfaction , you may be eligible to refer your complaint to th eFOS but must do so within six months of our final response letter. If you are eligible to refer your complaint to the FOS we will confirm this in our final response letter."
So - I guess I just sit still and wait for them to 'investigate'?? Do they have to do this inside a set timescale? Or them acknowledging my letter with this one enough? Interesting that they are 'apologise for any inconvenience' in this letter but since sending my letter to them, they have slapped ANOTHER £12 on there!!
Cheers.....0 -
