can i claim the admin fee from catalogues

  • its frustrating isn't it. I'm in just the mood for this this morning! I've registered on MCOL and just saved the claim. I've just written back to them saying that I will go through with MCOL if I don't hear from them within the next 14 days. So I've just re written down all of the charges plus the 8% interest and also the £35 court costs, so this now totals £483.80

    I'm going to go and post it now, so will let you know how I get on. Good Luck!!!

    I wish I had a better head for this! I'm looking back at what I've sent and I guess that was the 2nd letter that I've already sent as the first one just asked them for a list of all the charges. So, for my third letter, is it the FOS letter, or is there a different one that I should use thats threatening taking them to Court etc?

    I would amend a third letter and explain to them that you are allowing them one last chance to avoid legal costs by resolving this issue. Tell them that should they choose to ignore the letter and you will take them to court.
    Gromit, please please please read up on the court stuff. I know it is difficult but you got a lot of people here who will help you get your money back.

  • Hi I am struggling with this so I am hoping that someone might be able to help me! I 'own' freeman about £384 in late charges, I disagree, I am saying that all charges are unlawful...I have asked them to refund them, they have said no....I have now had it passed to a debt collection, who in turn has issued litigation proceedings against me for £467.44 (including court fee and solicitors fees) now, I want to defend it, I popped into a court to ask fro advise.they said to fill the forms in, then afterwards to send my claim to the FO...ok so far, but on this court form it asks me to put in my defence, I am not sure what to write,!! do I just say, I think the amount charges are unlawful and say I am going to the FO, and enclose copies of what I am claiming?...the court said I will have to go to court to defence myself, even though it will be in the hands of the FO, is that right?...the court said that is how the Companies get their money, as they are banking on people being to scare to defence it, its easlier to admit to it, and pay X a month..I don't see why I should, but I am really scared that I will have to defend this in court, when I am hopeing the FO will sort it out...help...not sure what to do next....:rolleyes:Lilly
  • Okay NWSM - I will do that but I dont even know where to start......I'm not far off giving up. I know folk on here are fantastic when it comes to helping and you have been great too...
    I'll go about 'penning' a third letter tonight when I'm not at work.

    we are in the same situation with shop direct had final response saying no so next stage issue mcol against them ?

    I went down the bank charge route a couple of years back, I.E requesting statements asking them to refund etc, is it the same with this? Also is there a sample nice letter floating about?

    It's the same as credit cards with catalogue accounts.
