    RM have taken recently to leaving small items (that are too big for the letter box) tied to my back door handle if I'm not in. :/

    When I saw this article in December I was interested as it had happened to me in the past.
    Obviously in the run-up to Christmas these things happen more and more.
    So...I am a big online shopper and three of my orders before Christmas messed up in one way or another:
    1. Beauty Express: a lot of items ordered - order came to just over £354.
    Several items were not delivered in the original delivery, stating there out of stock despite no notification of this when I ordered so would have to stay another day for their delivery. Then some items they said were in the box were not. Finally a couple of days after they 'accidentally' tried to take the whole of the order total again from my bank. A lot of phone calls had to be made to get them to take responsibility and let go of the money so it could be returned which took 5 days. Wrote to them about missing items and the whole mess - requesting a refund for one of the items not delivered, delivery of the missing items plus costs incurred by their mistakes.
    They ignored for a long time and now have offered 10% off next order but state they do not refund products and do not reimburse phone calls costs etc. Said I didn't have to write or call I could have emailed. Which I did and they ignored but when it came to the money being taken from my bank instant answers were required. All in all I've estimated that costs come close to £62 plus £30 for the missing product I want refunded.
    What do I do have mentioned court and not movement still?

    2. JJB: bought a football shirt for our son, got a text saying delivery would be on the 15th Dec in a 3 hour time slot - nothing arrived at all. Emailed them, called them and no response they didn't know what was going on HDNL weren't answering their phones, spent a whole day on the phone to an 0870 number - finding out the shirt was lost at one of their depots. Another delivery slot given and nothing came. Another morning on the phone then finally another shirt dispatched via Special Delivery which arrived. But again have asked for costs to be compensated totally about £100 due to time taken, phone call costs, general stress and effort. No response whatsoever - mentioned get compensation on one of the phone calls and they said I had to write which I have but they've ignored??
    Again have mentioned court.

    3. Kiddisave: bought our other son a highchair for Christmas - had it delivered but kept it in box for a week or so, few days before Christmas opened it to put it together to discover a huge crack in the base. Called and emailed them and they were very good getting another out to me and collecting the faulty one, however had to wait in for a 2nd day for delivery, stress, effort etc have asked for £62 in compensation.
    Again have totally ignored letter and have mentioned court?

    If anyone followed my case from page 8 of this thread.. the Insulation company that failed to carry out the cavity wall insulation work on two occasions have accepted my claim and I have paid them their fee's less my compensation.

    £62 for delivery issues in the run up to christmas?
    £100 compensation for a football shirt?
    £62 compensation for a product in a box which the retailer couldn't have known was damaged?

    What on earth makes you think you are entitled to these sorts of numbers. No business could remain in business if they were treated in the way you are treating them.

    This is why this guide is a bad idea, people claiming completely insane amounts for minor inconveniences...
  • The law is not good on granting "consequential damage" and arguing the toss gets much more expensive that the sums being argued about.

    If time and quality is absolutely of the essence of the contract - you need to get it written in right from the start (and little you won't be able to) .
  • hi, i perchased an item at xmas and never recived it, since then i have been refuned my payment put not my delivery which is £9.00,i have e mailed them text them rang and left message but no reply what shall i do next?
