I've used the template letter against a local insulation firm. They failed to carry out the insulation installation twice, and it wasn't until the third appointment they actually came and did the job.
I am claiming for a total of 9 hours of time off work. They have phoned today after receiving my letter to say they don't offer compensation for failed installation, and stating the fact that my 'priority booking' was their good will gesture. The priority booking they are referring to will be the fact that after the 2nd failed appointment, they booked me in for the 3rd appointment within 5 days.
So what now? I haven't yet paid for their services. So should I send them the due amount less my compensation and leave them to take it further with me if they wish? Or should I pay the invoice, then take them to court?
What would be seen as the correct thing to do in this situation by the courts?

You have to be absolutely sure of what you have told them your losses are, you can actually prove it. Otherwise you will meet them in the small claims court, when they sue for the shortfall.The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -

I can prove my earnings, and I have the contract letter stating the times between which they were supposed to attend.
What do you think will be the worst case scenario for going to the small claims court? Will I just have to pay them the difference (I claiming around £90 off their bill), or will I also owe their limitless court expenses?0 -
Websites rarely say if parcel needs signing for. I've tried leaving a note on door asking for parcel to be delivered to neighbour but UPS won't do it unless on delivery note. They leave a card on first attempt asking you to phone to rearrange but office closes at 17:00 so no good for working people. They then try to deliver again next day, hence the note on door. Then expected pick up from their depot miles away.
Alternatively Debenhams arrange a delivery without giving a firm date. Article was dropped in front garden with no note through door and only saw in dark by chance. No outer casing, only display box which was wet and soggy by the time I found it. Luckily article was OK.0 -

Why don't you put the extra instructions on the delivery instructions?
Because you arrive home from work at 17:20 - find the card and try and call them and they're closed, it's too late, they're coming again the next day whether that's any good for you or not.
A lot of sites don't give you any option to add additional instructions / comments to your order, and if they do, they don't always get passed on to the parcels carrier.0 -
Ordered a small TV in white for a specific day delivery from Co-op electricals online...Co-op delivered two black TVs and finally the correct one...so I lost two days' holidays having to stay in and wait for the delivery after the initial botched one.
I wrote a very short email to customer services basically just saying "how will you compensate for the lost days as you got the delivery wrong twice"...got a call from customer services couple of days later and straight off they offered £35 refund. :T Result. (Could have in theory tried to get more, but was quite happy with the refund considering the very little effort I put in trying to get some money back)0 -
Can we stay on topic? Forums are supposed to be informative, and it's easier for people browsing for information if they don't have to scroll through lots of bickering?!
Update: I have sent my payment for their invoice, deducting the compensation amount I am claiming. I have spoke to consumer protection, and can call on my solicitor if they attempt to take things further.. I'm assuming that will be the last of it, but I will post again if there is any news.

I ordered a netbook from Currys for delivery on Friday between 8.30 - 5. I sat in the front room and had a clear view of the window to ensure that I would not miss delivery . Nothing arrived by 4.30 so I called Currys I was told that they'd talk to the courier & get back but didn't. I called 5.30 was told it might still come and that they until 9pm. I asked them to look at their own T&C which stated by 5pm.Today when I checked I was told that they had tried to deliver but no one was in and that they had left a card. The time stated was 18.34. Later than the contracted time and while there WAS someone in and in full view of the window there was also no card put through the door. Currys have made a complaint to the delivery company but refuse a refund until they get goods back from Yodel. I explained that the contract had been breached by them and their failure to deliver. I also explained that this was a birthday gift and that now I unable to buy another gift as they are keeping my money until they get the goods back from the supplier. I asked how long all of this may take but they said that this is reliant on the delivery company returning the goods. I fail to understand how Currys can admit a problem but then charge me for it until the delivery contractor gets round to returning the goods that they did not deliver. Sorry if this sounds grumpy and repetitive it has now taken two hours of calls and I have no gift and no refund either. They promised to call back but have not done so again so I have sent them a letter claiming compensation. Stating my rights on the phone made no difference so I wonder if putting it in writing will. Has anyone else had success in this type of situation?0

I also had an undelivered parcel from Yodel nearly two weeks ago, with no explanation. The tracking website then said it had been signed for and delivered which was completely false! Had to take an extra day off to receive it in the end (and gambled that it would turn up - they never actually told me it would).

Does anyone know what counts as a "successful delivery"? My OH placed an order on Sunday with the delivery option stating "you can expect your order within 2-3 working days" (so no specific delivery date specified). It seems that Yodel attempted delivery yesterday while we were both at work and have left a note saying the parcel is at no.37 but the people living at no.37 say no package has been left with them.
Now Yodel's tracking system shows as delivered, but it has been delivered elsewhere essentially and we're unable to locate the item!You were only killing time and it'll kill you right back0
