eBay shafted me, advice please?

    If you had read the info on the help pages of Paypal it would have told you that the funds are released after 21 days, unless you receive positive FB, they are then released immediately, (you may have to contact them I'm not sure).
    Or 3 days after you can prove delivery with an online signature, so you post Monday, say, it would have had to be special delivery due to the value. You add the tracking info if you're funds aren't released automatically, contact Paypal on the Friday & they should release them.
    I would have shipped the phone, knowing that it would take around 4 days to get the funds into my Paypal account.
    Much quicker then all this faffing around. I'm also unsure as to why you thought that the 21 day hold wouldn't have applied on the second time of listing.
    You will no doubt have been blocked from either buying or selling on ebay in the future.

    You'l get a lot more sympathy if you stop blaming paypal and ebay for your mistake. Incidentally, can you confirm whether the second sale attempt was via a new paypal account and if so why weren't you using the original one. AS for payment, to sign up to a seller paypal account you must have had a card or a bank account showing somewhere.

    The second buyer will get a full refund as he can take out a full chargeback claim against you and paypal will refund him from your account and then persue you for the money. It's only the poor seller of the phone you bought that you are cheating as that seller has lost their FVFs and the cost of outward postage- plus all the inconvenience of a sale thrown away due to a timewaster.
    This wasn't a new PayPal account its the same account. I signed up for using a credit card. So your saying PayPal will come after me for £30 even though they won't return it? OK. And as for the seller they will get the fees back as soon as I became a non registered user. What your saying effectively is they will steal £30 from me?

    OP you need to call eBay and get them to refund the fees you paid, so you can refund your buyer the rest of the money.

    Tried selling on eBay again with a new Paypal account, exact same problem however this time I also got limited and they wanted me to confirm this that and the other and then eBay also restricted my account until I confirm the stuff with Paypal, so emailed in all requested and I am then told the limit will not be lifted.

    That should be done regardless, it's not his right to make the buyer out of pocket because of his series of mistakes.

    OP: I really can't stress enough this is why I'd never buy something worth £400 on eBay. Too many risks and too many sellers who don't know their responsibilities. When you sell, you sell to another person, you take their money in escrow (if the Paypal hold is present) so you do actually receive the money, it goes out of their account - you can't access it until they are happy but that is what you want anyway; you don't want to have spent the money and have them unhappily try to claw it back from Paypal and Paypal then chase you for it later on. There's no point buying anything costing £400 if I don't know my money is safe. Look at it from the buyer's point of view as well - that's a shedload of money to spend when you don't know or trust the vendor. What you are guilty of, really, is selfishness.

    And a point of order, Soo - a winning bid on eBay is a binding contract, it's defined as such by various decisions in various courts; for an auction the "fall of the hammer or other normal way" is the formation of the contract so eBay do have a right to claim that. Buyers will get more legal rights in 2013 in the case of auctions from business sellers so this is probably a good time to make that clear.

  • I just have to accept I've lost out, I emailed the guy and said I would refund him either via cheque or bank transfer, eBay make it impossible to get in touch with them once suspended but I suppose thats the point. Lesson learnt at my end.

    The way i see it, Sold phone and because its a popular scam item ebay decide to withold funds to keep the buyer and thenselves safe.

    Seller failed to complete that transaction and a red mark on the account.

    All done and dusted except a warning for the future?


    Seller sells the same item, That must be ringing alarm bells. Buys another phone but has not yet posted the
    one they sold..

    Buyer complains that no item received yet and Ebay decide seller is too much of a risk and cancels transactions.

    Why did you not post the phone you sold?

  • I think it's good the OP got banned, people like them who don't read through what should be done with eBay an PayPal deserve to be banned, it doesn't matter if they put a hold on the money, you have to send. It was stupid to sell something of high value as a first sale anyway, especially a mobile phone!!! angry-smiley-014.gif
